                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to The University of Texas at Brownsville and approval of
    1-3  new departments, schools, and programs.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Effective September 1, 1995, Sections 78.02(a)
    1-6  and (b), Education Code, are amended to read as follows:
    1-7        (a)  The board shall establish an <upper-level> educational
    1-8  institution in the City of Brownsville, to be known as The
    1-9  University of Texas at Brownsville.
   1-10        (b)  The <Except as provided by Subsection (c) of this
   1-11  section, the> university shall teach undergraduate- <only junior,
   1-12  senior,> and graduate-level courses.
   1-13        SECTION 2.  Section 78.03, Education Code, is amended by
   1-14  amending Subsection (a) and adding Subsections (d) and (e) to read
   1-15  as follows:
   1-16        (a)  The board may, if <authorize the university to offer any
   1-17  upper level or graduate course which is> authorized by the Texas
   1-18  Higher Education Coordinating Board, prescribe courses leading to
   1-19  customary degrees as are offered at leading American educational
   1-20  institutions and may award those degrees.
   1-21        (d)  At a minimum, the board, in accordance with Section
   1-22  61.055(b) of this code, shall offer:
   1-23              (1)  baccalaureate programs in psychology, computer
   1-24  science or information systems, public administration, art,
    2-1  nursing, hotel administration, business, environmental science,
    2-2  botany, chemistry, mathematics, medical technology, transportation,
    2-3  engineering technologies, Japanese, marine biology, sociology,
    2-4  aquaculture, anthropology, theater arts, communications, geography,
    2-5  geology, dance, philosophy, French, German, Italian, language
    2-6  translation or interpretation, music, physics, and Mexican American
    2-7  studies;
    2-8              (2)  master's programs in kinesiology, master teacher
    2-9  studies, political science, mathematics, English, history,
   2-10  government, business, criminal justice, accounting, curriculum and
   2-11  instruction in education, art, biology, botany, environmental
   2-12  science, marine biology, chemistry, computer science, special
   2-13  education, education of the gifted or talented, early childhood
   2-14  education, English as a second language, international studies,
   2-15  Spanish, language translation or interpretation, music, physics,
   2-16  psychology, and sociology; and
   2-17              (3)  doctoral programs in educational administration
   2-18  and in curriculum and instruction.
   2-19        (e)  Beginning with the fall semester in 1995, the board
   2-20  shall begin offering at least one-eighth of the courses and degrees
   2-21  required by this section.  Each academic year after the 1995-1996
   2-22  academic year, the board shall offer at least an additional
   2-23  one-eighth of the courses and degrees required by this section
   2-24  until all of the courses and degrees required by this section are
   2-25  being offered.  This subsection expires January 1, 2004.
   2-26        SECTION 3.  Subchapter C, Chapter 65, Education Code, is
   2-27  amended by adding Section 65.47 to read as follows:
    3-1        Sec. 65.47.  ENHANCEMENTS FOR THE UNIVERSITY OF TEXAS AT
    3-2  BROWNSVILLE.  To the extent that funds are available for this
    3-3  purpose, the board shall provide to The University of Texas at
    3-4  Brownsville funding that is equal to or greater than the funding
    3-5  provided to The University of Texas at Austin for:
    3-6              (1)  student support services;
    3-7              (2)  faculty salaries;
    3-8              (3)  libraries;
    3-9              (4)  student scholarships;
   3-10              (5)  student and faculty research;
   3-11              (6)  instructional and laboratory equipment; and
   3-12              (7)  community outreach programs.
   3-13        SECTION 4.  Section 61.055, Education Code, is amended to
   3-14  read as follows:
   3-15        Sec. 61.055.  Initiation of New Departments, Schools, and
   3-16  Programs.  (a)  Except as provided by Subsection (b) of this
   3-17  section, a <No> new department, school, or degree or certificate
   3-18  program approved by the board or its predecessor, the Texas
   3-19  Commission on Higher Education, may not be initiated by any
   3-20  institution of higher education until the board has made a written
   3-21  finding that the department, school, or degree or certificate
   3-22  program is adequately financed by legislative appropriation, by
   3-23  funds allocated by the board, or by funds from other sources.
   3-24        (b)  The coordinating board shall make a determination for
   3-25  approval or disapproval of any department, school, or program that
   3-26  is required by other law not later than the 13th month for doctoral
   3-27  programs and the ninth month for departments, schools, and programs
    4-1  other than doctoral programs after the date a complete application
    4-2  is submitted to the coordinating board seeking approval of the
    4-3  department, school, or program.
    4-4        SECTION 5.  Section 65.02(a), Education Code, is amended to
    4-5  read as follows:
    4-6        (a)  The University of Texas System is composed of the
    4-7  following institutions and entities:
    4-8              (1)  The University of Texas at Arlington, including
    4-9                    (A)  The University of Texas Institute of Urban
   4-10  Studies at Arlington; and
   4-11                    (B)  The University of Texas School of Nursing at
   4-12  Arlington;
   4-13              (2)  The University of Texas at Austin, including
   4-14                    (A)  The University of Texas Marine Science
   4-15  Institute;
   4-16                    (B)  The University of Texas McDonald Observatory
   4-17  at Mount Locke; and
   4-18                    (C)  The University of Texas School of Nursing at
   4-19  Austin;
   4-20              (3)  The University of Texas at Dallas;
   4-21              (4)  The University of Texas at El Paso, including The
   4-22  University of Texas School of Nursing at El Paso;
   4-23              (5)  The University of Texas of the Permian Basin;
   4-24              (6)  The University of Texas at San Antonio, including
   4-25  the University of Texas Institute of Texan Cultures at San Antonio;
   4-26              (7)  The University of Texas Southwestern Medical

    7-4        SECTION 6.  (a)  Except as otherwise provided by this Act,
    7-5  this Act takes effect immediately.
    7-6        (b)  To the extent that funds are available for this purpose,
    7-7  the board of regents of The University of Texas System shall
    7-8  provide the funding required by Section 65.47, Education Code, as
    7-9  added by this Act, beginning the fiscal year beginning September 1,
   7-10  1993.
   7-11        SECTION 7.  The importance of this legislation and the
   7-12  crowded condition of the calendars in both houses create an
   7-13  emergency and an imperative public necessity that the
   7-14  constitutional rule requiring bills to be read on three several
   7-15  days in each house be suspended, and this rule is hereby suspended,
   7-16  and that this Act take effect and be in force according to its
   7-17  terms, and it is so enacted.
