A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to The University of Texas at Brownsville.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Effective September 1, 1995, Sections 78.02(a)
1-5 and (b), Education Code, are amended to read as follows:
1-6 (a) The board shall establish an <upper-level> educational
1-7 institution in the City of Brownsville, to be known as The
1-8 University of Texas at Brownsville.
1-9 (b) The <Except as provided by Subsection (c) of this
1-10 section, the> university shall teach undergraduate- <only junior,
1-11 senior,> and graduate-level courses.
1-12 SECTION 2. Section 78.03, Education Code, is amended by
1-13 amending Subsection (a) and adding Subsection (d) to read as
1-14 follows:
1-15 (a) Except as provided by Subsection (d) of this section,
1-16 the <The> board may, if <authorize the university to offer any
1-17 upper-level or graduate course which is> authorized by the Texas
1-18 Higher Education Coordinating Board, prescribe courses leading to
1-19 customary degrees as are offered at leading American educational
1-20 institutions and may award those degrees.
1-21 (d) At a minimum, the board shall offer:
1-22 (1) baccalaureate programs in psychology, computer
1-23 science or information systems, public administration, art,
1-24 nursing, hotel administration, business, environmental science,
2-1 botany, chemistry, mathematics, medical technology, transportation,
2-2 engineering technologies, Japanese, marine biology, sociology,
2-3 aquaculture, anthropology, theater arts, communications, geography,
2-4 geology, dance, philosophy, French, German, Italian, language
2-5 translation or interpretation, music, physics, and Mexican American
2-6 studies;
2-7 (2) master's programs in kinesiology, master teacher
2-8 studies, political science, mathematics, English, history,
2-9 government, business, criminal justice, accounting, curriculum and
2-10 instruction in education, art, biology, botany, environmental
2-11 science, marine biology, chemistry, computer science, special
2-12 education, education of the gifted or talented, early childhood
2-13 education, English as a second language, international studies,
2-14 Spanish, language translation or interpretation, music, physics,
2-15 psychology, and sociology; and
2-16 (3) doctoral programs in educational administration
2-17 and in curriculum and instruction.
2-18 SECTION 3. Section 61.055, Education Code, is amended to
2-19 read as follows:
2-20 Sec. 61.055. Initiation of New Departments, Schools, and
2-21 Programs. Except as otherwise provided by law, a <No> new
2-22 department, school, or degree or certificate program approved by
2-23 the board or its predecessor, the Texas Commission on Higher
2-24 Education, may not be initiated by any institution of higher
2-25 education until the board has made a written finding that the
2-26 department, school, or degree or certificate program is adequately
2-27 financed by legislative appropriation, by funds allocated by the
3-1 board, or by funds from other sources.
3-2 SECTION 4. Section 65.02(a), Education Code, is amended to
3-3 read as follows:
3-4 (a) The University of Texas System is composed of the
3-5 following institutions and entities:
3-6 (1) The University of Texas at Arlington, including
3-7 (A) The University of Texas Institute of Urban
3-8 Studies at Arlington; and
3-9 (B) The University of Texas School of Nursing at
3-10 Arlington;
3-11 (2) The University of Texas at Austin, including
3-12 (A) The University of Texas Marine Science
3-13 Institute;
3-14 (B) The University of Texas McDonald Observatory
3-15 at Mount Locke; and
3-16 (C) The University of Texas School of Nursing at
3-17 Austin;
3-18 (3) The University of Texas at Dallas;
3-19 (4) The University of Texas at El Paso, including The
3-20 University of Texas School of Nursing at El Paso;
3-21 (5) The University of Texas of the Permian Basin;
3-22 (6) The University of Texas at San Antonio, including
3-23 the University of Texas Institute of Texan Cultures at San Antonio;
3-24 (7) The University of Texas Southwestern Medical
3-25 Center at Dallas, including
3-26 (A) The University of Texas Southwestern Medical
3-27 School at Dallas;
4-1 (B) The University of Texas Southwestern
4-2 Graduate School of Biomedical Sciences at Dallas; and
4-3 (C) The University of Texas Southwestern Allied
4-4 Health Sciences School at Dallas;
4-5 (8) The University of Texas Medical Branch at
4-6 Galveston, including

6-2 SECTION 5. (a) Except as otherwise provided by this Act,
6-3 this Act takes effect immediately.
6-4 (b) Not later than the beginning of the fall semester in
6-5 1995, the board of regents of The University of Texas System shall
6-6 begin offering the courses and degrees required by Section
6-7 78.03(d), Education Code, as added by this Act.
6-8 (c) Beginning with the fall semester in 1995, the board of
6-9 regents of The University of Texas System shall begin admitting
6-10 freshman and sophomore students to The University of Texas at
6-11 Brownsville.
6-12 SECTION 6. The importance of this legislation and the
6-13 crowded condition of the calendars in both houses create an
6-14 emergency and an imperative public necessity that the
6-15 constitutional rule requiring bills to be read on three several
6-16 days in each house be suspended, and this rule is hereby suspended,
6-17 and that this Act take effect and be in force according to its
6-18 terms, and it is so enacted.
