A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the Brush Country Underground Water Conservation
1-3 District.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. DEFINITION. In this Act, "district" means the
1-6 Brush Country Underground Water Conservation District.
1-7 SECTION 2. VALIDATION. All resolutions, orders, and other
1-8 acts or attempted acts of the board of directors of the district,
1-9 including the calling and holding of the confirmation and directors
1-10 election and of the directors election held on May 1, 1993, the
1-11 canvassing of the returns, declaring the results of the elections,
1-12 and the organization of the board, are validated in all respects.
1-13 All resolutions, orders, acts or attempted acts of the board of
1-14 directors of the district, including the calling and holding of the
1-15 confirmation and directors election and of the directors election
1-16 held on May 1, 1993, the canvassing of the returns, declaring the
1-17 results of the elections, and the organization of the board, are
1-18 valid as though they were originally legally authorized or
1-19 accomplished.
1-20 SECTION 3. AMENDMENT. Sections 1 and 2, Chapter 715, Acts
1-21 of the 71st Legislature, Regular Session, 1989, are amended to read
1-22 as follows:
1-23 Sec. 1. Creation of District. Under Article XVI, Section
1-24 59, of the Texas Constitution, the Live Oak <Brush Country>
2-1 Underground Water Conservation District is created as a
2-2 governmental agency and body politic and corporate, authorized to
2-3 exercise the powers essential to the accomplishment of the purposes
2-4 of that constitutional provision and to exercise the rights,
2-5 powers, duties, privileges, and functions provided by this Act and
2-6 by Chapters 51 and 52, Water Code, and by other laws of this state
2-7 relating to underground water conservation districts.
2-8 Sec. 2. Definition. In this Act, "district" means the Live
2-9 Oak <Brush Country> Underground Water Conservation District.
2-10 SECTION 4. PENDING LITIGATION. This Act does not apply to
2-11 or affect litigation now pending in any court of competent
2-12 jurisdiction in this state to which the district is a party.
2-13 SECTION 5. TRANSITION. (a) The change in name of the Brush
2-14 Country Underground Water Conservation District made by this Act
2-15 does not affect a power, duty, right, or obligation of the Brush
2-16 Country Underground Water Conservation District. A power, duty,
2-17 right, or obligation of the district under that name is a power,
2-18 duty, right, or obligation of the Live Oak Underground Water
2-19 Conservation District on the effective date of this Act.
2-20 (b) Directors elected from precincts 2 and 4 in the May 1,
2-21 1993, election serve until their successors qualify and take office
2-22 after the regularly scheduled election in 1994, as provided by
2-23 Section 12(e), Chapter 715, Acts of the 71st Legislature, Regular
2-24 Session, 1989.
2-25 (c) Directors elected from precincts 1 and 3 and the
2-26 director elected at large in the May 1, 1993, election serve until
2-27 their successors qualify and take office after the regularly
3-1 scheduled election in 1996, as provided by Section 12(e), Chapter
3-2 715, Acts of the 71st Legislature, Regular Session, 1989.
3-3 SECTION 6. EMERGENCY. The importance of this legislation
3-4 and the crowded condition of the calendars in both houses create an
3-5 emergency and an imperative public necessity that the
3-6 constitutional rule requiring bills to be read on three several
3-7 days in each house be suspended, and this rule is hereby suspended,
3-8 and that this Act take effect and be in force from and after its
3-9 passage, and it is so enacted.
