                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the Brush Country Underground Water Conservation
    1-3  District.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  DEFINITION.  In this Act, "district" means the
    1-6  Brush Country Underground Water Conservation District.
    1-7        SECTION 2.  VALIDATION.  All resolutions, orders, and other
    1-8  acts or attempted acts of the board of directors of the district
    1-9  including the calling and holding of the confirmation and directors
   1-10  election, the canvassing of the returns, declaring the results of
   1-11  the election, and the organization of the board, are validated in
   1-12  all respects.  All resolutions, orders, acts or attempted acts of
   1-13  the board of directors of the district, including the calling and
   1-14  holding of the confirmation and directors election, the canvassing
   1-15  of the returns, declaring the results of the election, and the
   1-16  organization of the board are valid as though they were originally
   1-17  legally authorized or accomplished.
   1-18        SECTION 3.  AMENDMENT.  Sections 1 and 2, Chapter 715, Acts
   1-19  of the 71st Legislature, Regular Session, 1989, are amended to read
   1-20  as follows:
   1-21        Sec. 1.  Creation of District.  Under Article XVI, Section
   1-22  59, of the Texas Constitution, the Live Oak <Brush Country>
   1-23  Underground Water Conservation District is created as a
   1-24  governmental agency and body politic and corporate, authorized to
    2-1  exercise the powers essential to the accomplishment of the purposes
    2-2  of that constitutional provision and to exercise the rights,
    2-3  powers, duties, privileges, and functions provided by this Act and
    2-4  by Chapters 51 and 52, Water Code, and by other laws of this state
    2-5  relating to underground water conservation districts.
    2-6        Sec. 2.  Definition.  In this Act, "district" means the Live
    2-7  Oak <Brush Country> Underground Water Conservation District.
    2-8        SECTION 4.  PENDING LITIGATION.  This Act does not apply to
    2-9  or affect litigation now pending in any court of competent
   2-10  jurisdiction in this state to which the district is a party.
   2-11        SECTION 5.  TRANSITION.  The change in name of the Brush
   2-12  Country Underground Water Conservation District made by this Act
   2-13  does not affect a power, duty, right, or obligation of the Brush
   2-14  Country Underground Water Conservation District.  A power, duty,
   2-15  right, or obligation of the district under that name is a power,
   2-16  duty, right, or obligation of the Live Oak Underground Water
   2-17  Conservation District on the effective date of this Act.
   2-18        SECTION 6.  EMERGENCY.  The importance of this legislation
   2-19  and the crowded condition of the calendars in both houses create an
   2-20  emergency and an imperative public necessity that the
   2-21  constitutional rule requiring bills to be read on three several
   2-22  days in each house be suspended, and this rule is hereby suspended,
   2-23  and that this Act take effect and be in force from and after its
   2-24  passage, and it is so enacted.
