1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to the Brush Country Underground Water Conservation
1-22 District.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. DEFINITION. In this Act, "district" means the
1-25 Brush Country Underground Water Conservation District.
1-26 SECTION 2. VALIDATION. All resolutions, orders, and other
1-27 acts or attempted acts of the board of directors of the district,
1-28 including the calling and holding of the confirmation and directors
1-29 election and of the directors election held on May 1, 1993, the
1-30 canvassing of the returns, declaring the results of the elections,
1-31 and the organization of the board, are validated in all respects.
1-32 All resolutions, orders, acts or attempted acts of the board of
1-33 directors of the district, including the calling and holding of the
1-34 confirmation and directors election and of the directors election
1-35 held on May 1, 1993, the canvassing of the returns, declaring the
1-36 results of the elections, and the organization of the board, are
1-37 valid as though they were originally legally authorized or
1-38 accomplished.
1-39 SECTION 3. AMENDMENT. Sections 1 and 2, Chapter 715, Acts
1-40 of the 71st Legislature, Regular Session, 1989, are amended to read
1-41 as follows:
1-42 Sec. 1. Creation of District. Under Article XVI, Section
1-43 59, of the Texas Constitution, the Live Oak <Brush Country>
1-44 Underground Water Conservation District is created as a
1-45 governmental agency and body politic and corporate, authorized to
1-46 exercise the powers essential to the accomplishment of the purposes
1-47 of that constitutional provision and to exercise the rights,
1-48 powers, duties, privileges, and functions provided by this Act and
1-49 by Chapters 51 and 52, Water Code, and by other laws of this state
1-50 relating to underground water conservation districts.
1-51 Sec. 2. Definition. In this Act, "district" means the Live
1-52 Oak <Brush Country> Underground Water Conservation District.
1-53 SECTION 4. PENDING LITIGATION. This Act does not apply to
1-54 or affect litigation now pending in any court of competent
1-55 jurisdiction in this state to which the district is a party.
1-56 SECTION 5. TRANSITION. (a) The change in name of the Brush
1-57 Country Underground Water Conservation District made by this Act
1-58 does not affect a power, duty, right, or obligation of the Brush
1-59 Country Underground Water Conservation District. A power, duty,
1-60 right, or obligation of the district under that name is a power,
1-61 duty, right, or obligation of the Live Oak Underground Water
1-62 Conservation District on the effective date of this Act.
1-63 (b) Directors elected from precincts 2 and 4 in the May 1,
1-64 1993, election serve until their successors qualify and take office
1-65 after the regularly scheduled election in 1994, as provided by
1-66 Section 12(e), Chapter 715, Acts of the 71st Legislature, Regular
1-67 Session, 1989.
1-68 (c) Directors elected from precincts 1 and 3 and the
2-1 director elected at large in the May 1, 1993, election serve until
2-2 their successors qualify and take office after the regularly
2-3 scheduled election in 1996, as provided by Section 12(e), Chapter
2-4 715, Acts of the 71st Legislature, Regular Session, 1989.
2-5 SECTION 6. EMERGENCY. The importance of this legislation
2-6 and the crowded condition of the calendars in both houses create an
2-7 emergency and an imperative public necessity that the
2-8 constitutional rule requiring bills to be read on three several
2-9 days in each house be suspended, and this rule is hereby suspended,
2-10 and that this Act take effect and be in force from and after its
2-11 passage, and it is so enacted.
