1-1 AN ACT
1-2 relating to the directors of the Gulf Coast Water Authority.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Sections 5 and 5(a), Chapter 712, Acts of the
1-5 59th Legislature, Regular Session, 1965 (Article 8280-339, Vernon's
1-6 Texas Civil Statutes), are amended to read as follows:
1-7 Sec. 5. The management and control of the District is hereby
1-8 vested in a Board of seven (7) directors. The directors shall
1-9 represent the geographic and ethnic diversity of the county. <Upon
1-10 the effective date of this Act, the following named persons shall
1-11 be and constitute the Board of Directors of said District:>
1-12 <Position 1: Arthur Alpert>
1-13 <Position 2: Alvin Kelso>
1-14 <Position 3: A. R. Anderson>
1-15 <Position 4: W. R. Nisbet>
1-16 <Position 5: C. J. Holgrave>
1-17 <Position 6: Charles Kilgore>
1-18 <Position 7: Gaddis Wittjen>
1-19 <who shall serve until May 1, 1967, and shall meet and organize as
1-20 soon as practicable after the effective date of this Act, and shall
1-21 file their official bonds and subscribe to the Constitutional Oath
1-22 of office.> Vacancies on the Board of Directors, whether by death,
1-23 resignation or termination of the term of office, shall be filled
1-24 by appointment by the Commissioners Court of Galveston County. All
2-1 terms of office shall be for a period of two (2) years. Terms
2-2 shall be staggered so that the terms of three (3) directors expire
2-3 one year and the terms of four (4) directors expire the next year
2-4 <except that the first term of office after May 1, 1967, for
2-5 Positions 2, 4 and 6 shall be for a term of one (1) year>. Three
2-6 (3) of the members appointed by the Commissioners Court shall be
2-7 registered professional engineers under the laws of Texas.
2-8 Sec. 5(a). One (1) director <Three (3) of the directors> of
2-9 the District shall be appointed by the Commissioners Court of
2-10 Galveston County upon the recommendation of the City Council of the
2-11 City of Galveston <and one (1) director of the District shall be
2-12 appointed by the Commissioners Court of Galveston County upon the
2-13 recommendation of the City Council of the City of Texas City>. The
2-14 remaining six (6) directors shall be appointed by the Commissioners
2-15 Court of Galveston County with two directors appointed at-large and
2-16 the remaining four directors appointed on the written
2-17 recommendation of advisory committees appointed by the Board of
2-18 Directors of the Gulf Coast Water Authority. Two directors shall
2-19 be recommended by the Mainland Municipal Advisory Committee and two
2-20 directors shall be recommended by the Industrial Advisory
2-21 Committee. The Commissioners Court of Galveston County is entitled
2-22 to accept or reject the recommendations made to the court by the
2-23 advisory committees. If a recommendation made by an advisory
2-24 committee is rejected, the advisory committee shall submit
2-25 additional recommendations to the court.
2-26 The Industrial Advisory Committee is composed of one
2-27 representative of each industrial customer of the Gulf Coast Water
3-1 Authority. The Mainland Municipal Advisory Committee is composed
3-2 of one representative of each municipal or water district customer
3-3 of the Gulf Coast Water Authority that uses not less than 2 million
3-4 gallons of water a day. The names of the representatives of each
3-5 of the committees shall be submitted to the Board of Directors of
3-6 the Gulf Coast Water Authority by the respective industrial and
3-7 municipal or water district customers. The directors of the Gulf
3-8 Coast Water Authority shall submit the names of the advisory
3-9 committee members to the Commissioners Court of Galveston County,
3-10 which shall record the names in the minutes of the court.
3-11 SECTION 2. This Act takes effect September 1, 1993.
3-12 SECTION 3. (a) To succeed the directors of the Gulf Coast
3-13 Water Authority whose terms expire in 1994, the Galveston County
3-14 Commissioners Court shall appoint four directors to serve terms
3-15 expiring September 1, 1996.
3-16 (b) To succeed the directors of the Gulf Coast Water
3-17 Authority whose terms expire in 1995, the Galveston County
3-18 Commissioners Court shall appoint three directors to serve terms
3-19 expiring September 1, 1997.
3-20 (c) Subsequent appointees serve two-year terms.
3-21 SECTION 4. The importance of this legislation and the
3-22 crowded condition of the calendars in both houses create an
3-23 emergency and an imperative public necessity that the
3-24 constitutional rule requiring bills to be read on three several
3-25 days in each house be suspended, and this rule is hereby suspended.
