35-8 ARTICLE III
35-9 SECTION 1. (a) Except as provided by Subsection (b) of this
35-10 section, in this Act, "tract," "block numbering area (BNA)," and
35-11 "block" mean the geographic areas identified by those terms on the
35-12 P.L. 94-171 County Block Maps (1990), or on the 1990 Census
35-13 TIGER/Line File, prepared by the United States Department of
35-14 Commerce Bureau of the Census for the Twenty-first Decennial Census
35-15 of the United States, enumerated as of April 1, 1990, as set out in
35-16 the Redistricting Map Data Base for the State of Texas prepared by
35-17 the Texas Legislative Council and distributed by the council to the
35-18 State Data Center, Texas Department of Commerce, on March 22, 1991,
35-19 for public distribution by the State Data Center. If a tract, BNA,
35-20 or block as set out in the Redistricting Map Data Base for the
35-21 State of Texas differs from a tract, BNA, or block as set out in
35-22 the P.L. 94-171 County Block Maps (1990) or 1990 Census TIGER/Line
35-23 File, this Act refers to the tract, BNA, or block according to the
35-24 Redistricting Map Data Base for the State of Texas.
35-25 (b) In this Act, a water block designated by a number ending
35-26 in the digits "99" followed by a suffixed letter (e.g., block 299A,
35-27 block 599Z) means that portion of the corresponding census block
36-1 (that is, the census block designated by the same number but
36-2 without the suffixed letter) as delineated and designated on the
36-3 Redistricting Map Data Base for the State of Texas prepared by the
36-4 Texas Legislative Council and distributed by the council to the
36-5 State Data Center, Texas Department of Commerce, on March 22, 1991,
36-6 for public distribution by the State Data Center. In this
36-7 subsection, census block means a block as designated by the United
36-8 States Department of Commerce Bureau of the Census on the official
36-9 P.L. 94-171 County Block Maps (1990) or on the 1990 Census
36-10 TIGER/Line File.
36-11 (c) This subsection applies only to a provision of this Act
36-12 that describes portions of a tract that is divided between two or
36-13 more districts. If a water block depicted on official P.L. 94-171
36-14 County Block Maps (1990) or contained on the 1990 Census TIGER/Line
36-15 File is not listed in this Act, the water block or each separate
36-16 portion of the water block is included in the contiguous block in
36-17 which the water block or portion of the water block is contained.
36-18 If the water block or portion of the water block is contiguous with
36-19 more than one other block, the water block or portion of the water
36-20 block is included in the contiguous block with which it shares the
36-21 longest common boundary according to the P.L. 94-171 County Block
36-22 Maps (1990) or 1990 Census TIGER/Line File.
36-23 SECTION 2. It is the intention of the Texas Legislature
36-24 that, if any county, tract, block numbering area, block, or other
36-25 geographic area has erroneously been left out of this Act, a court
36-26 reviewing this Act should include that area in the appropriate
36-27 district in accordance with the intent of the legislature, using
37-1 any available evidence of that intent, including but not limited to
37-2 such evidence as that used by the Supreme Court of Texas in Smith
37-3 v. Patterson, 111 Tex. 535, 242 S.W. 749 (1922).
37-4 SECTION 3. This Act takes effect beginning with the election
37-5 of the 73rd Legislature, but it does not affect the membership,
37-6 personnel, or districts of the 72nd Legislature. If a vacancy
37-7 occurs in the office of any member of the senate of the 72nd
37-8 Legislature and a special election to fill the vacancy is
37-9 necessary, the election shall be held in the district as it existed
37-10 on January 1, 1991.
37-11 SECTION 4. The importance of this legislation and the
37-12 crowded condition of the calendars in both houses create an
37-13 emergency and an imperative public necessity that the
37-14 constitutional rule requiring bills to be read on three several
37-15 days in each house be suspended, and this rule is hereby suspended,
37-16 and that this Act take effect and be in force from and after its
37-17 passage, and it is so enacted.
