                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to a cause of action against a governmental entity or a
    1-3  governmental risk pool.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 101.027, Civil Practice and Remedy Code,
    1-6  is amended by adding subsection (d) to read as follows:
    1-7        Sec. 101.027.  LIABILITY INSURANCE
    1-8        (a)  Each governmental unit may purchase insurance policies
    1-9  protecting the unit and the unit's employees against claims under
   1-10  this chapter.
   1-11        (b)  The policies may relinquish to the insurer the right to
   1-12  investigate, defend, compromise, and settle any claim under this
   1-13  chapter to which the insurance coverage extends.
   1-14        (c)  This state or a political subdivision of the state may
   1-15  not require an employee to purchase liability insurance as a
   1-16  condition of employment if the state or the political subdivision
   1-17  is insured by a liability insurance policy.
   1-18        (d)  Nothing in this chapter shall permit a cause of action
   1-19  against a governmental entity or a governmental risk pool and its
   1-20  agents for the breach of any alleged duty of good faith and fair
   1-21  dealing.
   1-22        SECTION 2.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended.
