                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to governmental authority and voter rights in the
    1-3  extraterritorial jurisdiction of a municipality.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter Z, Chapter 42, Local Government Code,
    1-6  is amended by adding Section 42.904 to read as follows:
    1-7        Sec. 42.904.  EXTRATERRITORIAL JURISDICTION AND VOTING
    1-8  RIGHTS.  A municipality shall allow all qualified voters residing
    1-9  in the municipality's extraterritorial jurisdiction to vote on any
   1-10  proposition that is submitted to the voters of the municipality and
   1-11  that involves an adoption of or change to an ordinance or charter
   1-12  provision that would apply to the municipality's extraterritorial
   1-13  jurisdiction.
   1-14        SECTION 2.  This Act does not affect the validity of an
   1-15  ordinance or charter provision adopted before the effective date of
   1-16  this Act other than an ordinance or charter provision relating to
   1-17  persons eligible to vote in municipal elections.
   1-18        SECTION 3.  The importance of this legislation and the
   1-19  crowded condition of the calendars in both houses create an
   1-20  emergency and an imperative public necessity that the
   1-21  constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended,
   1-23  and that this Act take effect and be in force from and after its
   1-24  passage, and it is so enacted.
