   1-20                         A BILL TO BE ENTITLED
   1-21                                AN ACT
   1-22  relating to the provision of transportation services to certain
   1-23  AFDC recipients by mass transit authorities.
   1-24        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-25        SECTION 1.  Chapter 141, Acts of the 63rd Legislature,
   1-26  Regular Session, 1973 (Article 1118x, Vernon's Texas Civil
   1-27  Statutes), is amended by adding Section 15C to read as follows:
   1-28        Sec. 15C.  TRANSPORTATION SERVICES FOR CERTAIN JOBS PROGRAM
   1-29  PARTICIPANTS.  (a)  An authority shall, in accordance with federal
   1-30  law, provide transportation services to a person who:
   1-31              (1)  is receiving financial assistance under Chapter
   1-32  31, Human Resources Code;
   1-33              (2)  is registered in the jobs opportunities and basic
   1-34  skills (JOBS) training program under Part F, Subchapter IV, Social
   1-35  Security Act (42 U.S.C.  Section 682); and
   1-36              (3)  resides in an area served by the authority.
   1-37        (b)  An authority shall enter into a contract with the Texas
   1-38  Department of Human Services to provide the transportation services
   1-39  required under this section.  The terms of the contract must ensure
   1-40  that:
   1-41              (1)  the authority is required to provide
   1-42  transportation services only to a location that relates to the
   1-43  person's participation in the JOBS program and that is in the area
   1-44  served by the authority's authorized rate structure and existing
   1-45  services;
   1-46              (2)  the authority is required to provide directly to
   1-47  the Texas Department of Human Services trip vouchers for
   1-48  distribution by the department to a person who is eligible to
   1-49  receive transportation services under this section;
   1-50              (3)  the Texas Department of Human Services reimburses
   1-51  the authority at the applicable federal match rate for allowable
   1-52  costs; and
   1-53              (4)  the Texas Department of Human Services may return
   1-54  to the authority for reimbursement any undistributed trip vouchers.
   1-55        (c)  An authority shall certify the amount of public funds
   1-56  expended by the authority under this section for the purpose of
   1-57  obtaining federal funds under the JOBS program.
   1-58        SECTION 2.  Chapter 683, Acts of the 66th Legislature, 1979
   1-59  (Article 1118y, Vernon's Texas Civil Statutes), is amended by
   1-60  adding Section 21A to read as follows:
   1-61        Sec. 21A.  TRANSPORTATION SERVICES FOR CERTAIN JOBS PROGRAM
   1-62  PARTICIPANTS.  (a)  An authority shall, in accordance with federal
   1-63  law, provide transportation services to a person who:
   1-64              (1)  is receiving financial assistance under Chapter
   1-65  31, Human Resources Code;
   1-66              (2)  is registered in the jobs opportunities and basic
   1-67  skills (JOBS) training program under Part F, Subchapter IV, Social
   1-68  Security Act (42 U.S.C.  Section 682); and
    2-1              (3)  resides in an area served by the authority.
    2-2        (b)  An authority shall enter into a contract with the Texas

   2-23        SECTION 3.  Article 1118z, Revised Statutes, is amended by
   2-24  adding Section 6A to read as follows:
   2-25        Sec. 6A.  TRANSPORTATION SERVICES FOR CERTAIN JOBS PROGRAM
   2-26  PARTICIPANTS.  (a)  A department shall, in accordance with federal
   2-27  law, provide transportation services to a person who:
   2-28              (1)  is receiving financial assistance under Chapter
   2-29  31, Human Resources Code;
   2-30              (2)  is registered in the jobs opportunities and basic
   2-31  skills (JOBS) training program under Part F, Subchapter IV, Social
   2-32  Security Act (42 U.S.C.  Section 682); and
   2-33              (3)  resides in an area served by the department.
   2-34        (b)  A department shall enter into a contract with the Texas
   2-35  Department of Human Services to provide the transportation services
   2-36  required under this section.  The terms of the contract must ensure
   2-37  that:
   2-38              (1)  the department is required to provide
   2-39  transportation services only to a location that relates to the
   2-40  person's participation in the JOBS program and that is in the area
   2-41  served by the department's authorized rate structure and existing
   2-42  services;
   2-43              (2)  the department is required to provide directly to
   2-44  the Texas Department of Human Services trip vouchers for
   2-45  distribution by the Texas Department of Human Services to a person
   2-46  who is eligible to receive transportation services under this
   2-47  section;
   2-48              (3)  the Texas Department of Human Services reimburses
   2-49  the department at the applicable federal match rate for allowable
   2-50  costs; and
   2-51              (4)  the Texas Department of Human Services may return
   2-52  to the department for reimbursement any undistributed trip
   2-53  vouchers.
   2-54        (c)  A department shall certify the amount of public funds
   2-55  expended by the department under this section for the purpose of
   2-56  obtaining federal funds under the JOBS program.
   2-57        SECTION 4.  If, before implementing the requirements of
   2-58  Sections 1, 2, and 3 of this Act, the Texas Department of Human
   2-59  Services determines that a waiver or authorization from a federal
   2-60  agency is necessary for implementation, the Texas Department of
   2-61  Human Services shall request the waiver or authorization, and the
   2-62  department and each mass transit authority or department may delay
   2-63  implementing those provisions until the waiver or authorization is
   2-64  granted.
   2-65        SECTION 5.  This Act takes effect September 1, 1993.
   2-66        SECTION 6.  The importance of this legislation and the
   2-67  crowded condition of the calendars in both houses create an
   2-68  emergency and an imperative public necessity that the
   2-69  constitutional rule requiring bills to be read on three several
   2-70  days in each house be suspended, and this rule is hereby suspended.
