H.B. No. 2271 1-1 AN ACT 1-2 relating to the ability of the Texas Water Development Board to 1-3 obtain insurance and exempting Texas Water Development Board 1-4 members and employees from personal liability relating to board 1-5 business. 1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-7 SECTION 1. Subchapter D, Chapter 6, Water Code, is amended 1-8 by adding Sections 6.108 and 6.109 to read as follows: 1-9 Sec. 6.108. POWER TO PURCHASE INSURANCE. The board may 1-10 purchase for its members, appointees, and employees and pay 1-11 premiums on liability insurance in any amounts and from any 1-12 insurers the board considers advisable. 1-13 Sec. 6.109. LIABILITY. Pursuant to the limited waiver of 1-14 governmental immunity of Chapter 101, Civil Practice and Remedies 1-15 Code (Texas Tort Claims Act), neither a member of the board nor any 1-16 employee of the board is personally liable in the person's private 1-17 capacity for any act performed or for any contract or other 1-18 obligation entered into or undertaken in an official capacity in 1-19 good faith and without intent to defraud, in connection with the 1-20 administration, management, or conduct of the board in its 1-21 business, programs, or other related affairs. 1-22 SECTION 2. The importance of this legislation and the 1-23 crowded condition of the calendars in both houses create an 2-1 emergency and an imperative public necessity that the 2-2 constitutional rule requiring bills to be read on three several 2-3 days in each house be suspended, and this rule is hereby suspended, 2-4 and that this Act take effect and be in force from and after its 2-5 passage, and it is so enacted.
