No. 2271 By: Carriker 1-21 A BILL TO BE ENTITLED 1-22 AN ACT 1-23 relating to the ability of the Texas Water Development Board to 1-24 obtain liability insurance, and exempting Texas Water Development 1-25 Board members and employees from personal liability relating to 1-26 board business, and declaring an emergency. 1-27 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-28 SECTION 1. Chapter 6, Texas Water Code, is amended by adding 1-29 Sections 6.108 and 6.109 to read as follows: 1-30 Sec. 6.108. Power to Purchase Liability Insurance. 1-31 The board may purchase for its members, appointees, and 1-32 employees and pay premiums on liability insurance, in any amounts, 1-33 and from any insurers the board considers advisable. 1-34 Sec. 6.109. Liability. 1-35 Neither a member of the board nor any employee of the board 1-36 is personally liable in the person's private capacity for any act 1-37 performed or for any contract or other obligation entered into or 1-38 undertaken in an official capacity in good faith and without intent 1-39 to defraud, in connection with the administration, management or 1-40 conduct of the board in its business, programs or other related 1-41 affairs. 1-42 SECTION 2. EMERGENCY. The importance of this legislation 1-43 and the crowded condition of the calendars in both houses create an 1-44 emergency and imperative public necessity that the constitutional 1-45 rule requiring bills to be read on three several days in each house 1-46 be suspended, and this Act take effect and be in force from and 1-47 after its passage, and it is so enacted. 1-48 * * * * * 1-49 Austin, 1-50 Texas 1-51 May 25, 1993 1-52 Hon.
