1-21 COMMITTEE AMENDMENT NO. 1 By: Carriker
1-22 Amend H.B. 2281 as follows:
1-23 Strike the existing Sec. 401.032, on page 1, lines 46 through
1-24 50 and replace with the following:
1-25 Sec. 401.032. OTHER GIFTS. Unsolicited benefits received by
1-26 the governor which are prohibited under Section 36.08 of the Penal
1-27 Code may be donated to a governmental entity that has the authority
1-28 to accept the gift or may donate the benefit to a recognized
1-29 tax-exempt charitable organization formed for educational,
1-30 religious or scientific purposes.

1-32 AN ACT
1-33 relating to the acceptance of gifts and grants by the governor.
1-34 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-35 SECTION 1. Chapter 401, Government Code, is amended by
1-36 adding Subchapter C to read as follows:
1-37 SUBCHAPTER C. OFFICE OF THE GOVERNOR
1-38 Sec. 401.031. ACCEPTANCE OF GIFTS, GRANTS, AND DONATIONS BY
1-39 THE GOVERNOR. (a) The governor may accept gifts, grants, and
1-40 donations of money or property on behalf of the state for any
1-41 lawful public purpose related to the office of governor.
1-42 (b) The governor may decline to accept a gift, grant, or
1-43 donation that is made for a specific purpose if the governor
1-44 determines the gift may not be used reasonably or economically for
1-45 the designated purpose.
1-46 Sec. 401.032. OTHER GIFTS. (a) Gifts offered to the
1-47 governor personally and accepted on behalf of the state may be
1-48 donated by the governor to any agency of state or local government.
1-49 (b) The governor shall keep a record of the receipt and
1-50 disposition of gifts received under this section.
1-51 SECTION 2. The importance of this legislation and the
1-52 crowded condition of the calendars in both houses create an
1-53 emergency and an imperative public necessity that the
1-54 constitutional rule requiring bills to be read on three several
1-55 days in each house be suspended, and this rule is hereby suspended,
1-56 and that this Act take effect and be in force from and after its
1-57 passage, and it is so enacted.
