A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to campus peace officers at the University of North Texas.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 105.91(a), Education Code, is amended to
1-5 read as follows:
1-6 (a) Campus peace officers <security personnel> commissioned
1-7 under Section 51.203 of this code have concurrent jurisdiction with
1-8 police officers of the City of Denton to enforce all criminal laws,
1-9 including traffic laws, of the state and all ordinances of the city
1-10 regulating traffic on any public street running through the
1-11 property of the university and on any public street immediately
1-12 adjacent to property owned or occupied and controlled by the
1-13 university.
1-14 SECTION 2. Subchapter G, Chapter 105, Education Code, is
1-15 amended by adding Section 105.941 to read as follows:
1-16 Sec. 105.941. CAMPUS RESERVE FORCE. (a) The board of
1-17 regents of the University of North Texas may establish a campus
1-18 reserve force to maintain campus security. The board of regents
1-19 may limit the size of the campus reserve force.
1-20 (b) The chief of police of the campus peace officers, with
1-21 the approval of the board of regents, shall appoint reserve law
1-22 enforcement officers to serve in the campus reserve force at the
1-23 discretion of the chief of police.
1-24 (c) The chief of police may call a member of the campus
2-1 reserve force to serve at any time the chief of police determines
2-2 that service is necessary to preserve campus security or to enforce
2-3 the law.
2-4 (d) Except as provided by Subsection (e) of this section, a
2-5 member of the campus reserve force, during the actual discharge of
2-6 the member's duties, serves as a peace officer and has the same
2-7 rights, privileges, and duties as any other peace officer of this
2-8 state.
2-9 (e) A member of the campus reserve force may not carry a
2-10 weapon unless authorized to carry a weapon by the chief of police.
2-11 (f) A member of the campus reserve force may act only in a
2-12 supplementary capacity to the campus peace officers and may not
2-13 assume the full-time duties of campus peace officers without
2-14 complying with the requirements for campus peace officers.
2-15 SECTION 3. The importance of this legislation and the
2-16 crowded condition of the calendars in both houses create an
2-17 emergency and an imperative public necessity that the
2-18 constitutional rule requiring bills to be read on three several
2-19 days in each house be suspended, and this rule is hereby suspended,
2-20 and that this Act take effect and be in force from and after its
2-21 passage, and it is so enacted.
