                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to availability of and eligibility requirements for
    1-3  facility engineering in economically distressed areas.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 15.407, Water Code, is amended by adding
    1-6  Subsection (g) to read as follows:
    1-7        (g)  The board by rule may:
    1-8              (1)  require that funds be available through the
    1-9  research and planning fund or the development fund to political
   1-10  subdivisions in affected areas up to 100 percent of the cost of
   1-11  facility engineering for water and wastewater facilities to serve
   1-12  economically distressed areas; þLandää
   1-13              þL(2)  allow a district or nonprofit water supply
   1-14  corporation to apply for assistance from the board if the eligible
   1-15  county or municipality in which the economically distressed area is
   1-16  located does not intend to apply for financial assistance for the
   1-17  same project in the same area, which as to the municipality
   1-18  includes the area within the corporate limits and within a
   1-19  five-mile extraterritorial jurisdiction.ää
   1-20        SECTION 2.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended,
    2-2  and that this Act take effect and be in force from and after its
    2-3  passage, and it is so enacted.
