                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the organization and regulation of the State Department
    1-3  of Education.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subsection 11.62, Education Code, is amended to
    1-6  read as follows:
    1-7        Sec. 11.62.  Organization and Regulations.  (a)  The State
    1-8  Department of Education shall be organized into divisions and
    1-9  subdivisions established by the commissioner of education <subject
   1-10  to the approval of the State Board of Education>.
   1-11        (b)  Directors of the major divisions of the State Department
   1-12  of Education, and all of its other employees, shall be appointed by
   1-13  the commissioner of education <pursuant to general rules and
   1-14  regulations adopted by the State Board of Education>.
   1-15        (c)  The rules and regulations pertaining to personnel
   1-16  administration shall include a comprehensive classification plan,
   1-17  including an appropriate title for each position, a description of
   1-18  duties and responsibilities, and the minimum requirements of
   1-19  training, experience, and other qualifications essential for
   1-20  adequate performance of the work.  These rules and regulations
   1-21  shall likewise provide <tenure safeguards,> leave and retirement
   1-22  provisions, and establish hearing procedures.
   1-23        SECTION 2.  The importance of this legislation and the
    2-1  crowded condition of the calendars in both houses create an
    2-2  emergency and an imperative public necessity that the
    2-3  constitutional rule requiring bills to be read on three several
    2-4  days in each house be suspended, and this rule is hereby suspended,
    2-5  and that this Act take effect and be in force from and after its
    2-6  passage, and it is so enacted.
