No. 2400 73R5153 MLR-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to location of sightings of threatened and endangered 1-3 species. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Chapter 67, Parks and Wildlife Code, is amended 1-6 by adding Section 67.006 to read as follows: 1-7 Sec. 67.006. INFORMATION ON LOCATION EXEMPT FROM OPEN 1-8 RECORDS LAW. Information collected under this chapter that 1-9 specifies the location of a sighting or occurrence of a species 1-10 listed or proposed for listing as threatened under Chapter 68 of 1-11 this code or under federal law is not public information and is 1-12 excepted from disclosure under the open records law, Chapter 424, 1-13 Acts of the 63rd Legislature, Regular Session, 1973 (Article 1-14 6252-17a, Vernon's Texas Civil Statutes), except that a landowner 1-15 has the right to obtain information about a sighting or occurrence 1-16 on the landowner's property. 1-17 SECTION 2. Chapter 68, Parks and Wildlife Code, is amended 1-18 by adding Section 68.022 to read as follows: 1-19 Sec. 68.022. INFORMATION ON LOCATION EXEMPT FROM OPEN 1-20 RECORDS LAW. Information that specifies the location of a sighting 1-21 or occurrence of a species listed or proposed for listing as 1-22 endangered under this chapter or under federal law is not public 1-23 information and is excepted from disclosure under the open records 1-24 law, Chapter 424, Acts of the 63rd Legislature, Regular Session, 2-1 1973 (Article 6252-17a, Vernon's Texas Civil Statutes), except that 2-2 a landowner has the right to obtain information about a sighting or 2-3 occurrence on the landowner's property. 2-4 SECTION 3. Chapter 88, Parks and Wildlife Code, is amended 2-5 by adding Section 88.013 to read as follows: 2-6 Sec. 88.013. INFORMATION ON LOCATION EXEMPT FROM OPEN 2-7 RECORDS LAW. Information that specifies the location of a sighting 2-8 or occurrence of a species listed or proposed for listing as 2-9 endangered, threatened, or protected under this chapter or under 2-10 federal law is not public information and is excepted from 2-11 disclosure under the open records law, Chapter 424, Acts of the 2-12 63rd Legislature, Regular Session, 1973 (Article 6252-17a, Vernon's 2-13 Texas Civil Statutes), except that a landowner has the right to 2-14 obtain information about a sighting or occurrence on the 2-15 landowner's property. 2-16 SECTION 4. This Act takes effect September 1, 1993. 2-17 SECTION 5. The importance of this legislation and the 2-18 crowded condition of the calendars in both houses create an 2-19 emergency and an imperative public necessity that the 2-20 constitutional rule requiring bills to be read on three several 2-21 days in each house be suspended, and this rule is hereby suspended.
