A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the suspension of a public school teacher without pay.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 13.113, Education Code, is amended to
1-5 read as follows:
1-6 Sec. 13.113. Suspension Without Pay. (a) The board of
1-7 trustees of a school district may suspend a teacher without pay for
1-8 any of the reasons set forth in Section 13.109 of this code or for
1-9 a reason set forth in Section 13.110(1)-(5), (7), or (8) of this
1-10 code. The board may delegate this authority to the superintendent
1-11 of schools. A suspension under this subsection is effective for a
1-12 specified period not to exceed 30 days as provided by board policy
1-13 and may take effect only after an administrative hearing regarding
1-14 the allegations against the teacher.
1-15 (b) If the board proposes to <proposed action be> discharge
1-16 a <of the> teacher for any of the reasons set forth in Section
1-17 13.109 of this code, the teacher may be suspended without pay by
1-18 order of the board of trustees, or by the superintendent of schools
1-19 if such power has been delegated to him by express regulation
1-20 previously adopted by the board of trustees, but in such event the
1-21 hearing shall not be delayed for more than 15 days after request
1-22 for hearing, unless by written consent of the teacher.
1-23 SECTION 2. This Act takes effect September 1, 1993.
1-24 SECTION 3. The importance of this legislation and the
2-1 crowded condition of the calendars in both houses create an
2-2 emergency and an imperative public necessity that the
2-3 constitutional rule requiring bills to be read on three several
2-4 days in each house be suspended, and this rule is hereby suspended.
