                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the punishment for failing to stop in an accident
    1-3  involving death or personal injury.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 38 (b), Uniform Act Regulating Traffic on
    1-6  the Highways, (Article 6701d, Vernon's Texas Civil Statutes), is
    1-7  amended by amending Subsection (b) and by adding Subsection (c) to
    1-8  read as follows:
    1-9        (b)  Any person failing to stop or to comply with said
   1-10  requirements under such circumstances shall upon conviction be
   1-11  punished by imprisonment in the penitentiary not to exceed five (5)
   1-12  years or in jail not exceeding one (1) year or by fine not
   1-13  exceeding Five Thousand ($5,000.00) Dollars, or by both such fine
   1-14  and imprisonment if the accident involves personal injuries only.
   1-15        (c)  Any person failing to stop or to comply with said
   1-16  requirements under such circumstances commits an offense.  An
   1-17  offense under this subsection is a felony of the third degree if
   1-18  the accident results in the death of a person.
   1-19        SECTION 2.  This Act takes effect September 1, 1993.
   1-20        SECTION 3.  An offense committed before September 1, 1993, is
   1-21  covered by the law in effect when the offense is committed, and the
   1-22  formal law is continued in effect for this purpose.
   1-23        SECTION 4.  The importance of this legislation and the
    2-1  crowded condition of the calendars in both houses create an
    2-2  emergency and an imperative public necessity that the
    2-3  constitutional rule requiring bills to be read on three several
    2-4  days in each house be suspended, and this rule is hereby suspended.
