A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to reporting requirements of farm-raised aquatic products.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 66.019, Parks and Wildlife Code, is
1-5 amended to read as follows:
1-6 Sec. 66.019. Statistical Reports. (a) The department shall
1-7 gather statistical information on the harvest of aquatic products
1-8 of this state.
1-9 (b) The department shall prescribe, produce, and distribute
1-10 the report form. The form shall be designed to allow for
1-11 statistical information concerning the numbers and quantity by
1-12 weight of each species taken, the kinds of equipment used to take
1-13 each species, and the name of the body of water from which each
1-14 species was taken.
1-15 (c) No dealer who purchases or receives aquatic products
1-16 directly from any person other than a licensed dealer may fail to
1-17 file the report with the department each month on or before the
1-18 10th day of the month following the month in which the reportable
1-19 activity occurred<.>, except a dealer who purchases or receives
1-20 farm-raised hybrid striped bass or redfish, who is required to file
1-21 the report annually. The report must be filed even if no
1-22 reportable activity occurs in the month covered by the report. No
1-23 dealer required to report may file an incorrect or false report. A
2-1 culpable mental state is not required to establish an offense under
2-2 this section.
2-3 SECTION 2. The importance of this legislation and the
2-4 crowded condition of the calendars in both houses create an
2-5 emergency and an imperative public necessity that the
2-6 constitutional rule requiring bills be read on three several days
2-7 in each house be suspended, and this rule is hereby suspended.
