A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to ex parte communications by members of the State
1-3 Commission on Judicial Conduct.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter A, Chapter 33, Government Code, is
1-6 amended by adding Section 33.006 to read as follows:
1-7 Sec. 33.006. EX PARTE COMMUNICATIONS. Members of the State
1-8 Commission on Judicial Conduct are prohibited from any ex parte
1-9 communication with any judge who is the subject of an investigation
1-10 being conducted by the commission.
1-11 SECTION 2. This Act takes effect September 1, 1993, and
1-12 applies to an investigation of judicial conduct under Chapter 33,
1-13 Government Code, that is pending on the effective date of this Act,
1-14 without regard to whether the investigation was commenced before or
1-15 is commenced on or after the effective date of this Act, and in
1-16 which, on the effective date of this Act, formal proceedings under
1-17 Section 33.022(b), Government Code, have not been commenced.
1-18 SECTION 3. The importance of this legislation and the
1-19 crowded condition of the calendars in both houses create an
1-20 emergency and an imperative public necessity that the
1-21 constitutional rule requiring bills to be read on three several
1-22 days in each house be suspended, and this rule is hereby suspended.
