                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the consolidation and dedication of certain funds.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 361.133(a), Health and Safety Code, is
    1-5  amended to read as follows:
    1-6        (a)  The hazardous and solid waste remediation fee fund is in
    1-7  the state treasury.  The fund is exempt from the application of
    1-8  Sections 403.094(h) and 403.095, Government Code.
    1-9        SECTION 2.  Section 382.0622(b), Health and Safety Code, is
   1-10  amended to read as follows:
   1-11        (b)  Clean Air Act fees shall be deposited in the state
   1-12  treasury to the credit of the clean air fund and shall be used to
   1-13  safeguard the air resources of the state.  The fund is exempt from
   1-14  the application of Sections 403.094(h) and 403.095, Government
   1-15  Code.  <All unexpended and unobligated money remaining in the fund
   1-16  on the last day of each fiscal biennium shall be transferred to the
   1-17  credit of the general revenue fund.>
   1-18        SECTION 3.  The importance of this legislation and the
   1-19  crowded condition of the calendars in both houses create an
   1-20  emergency and an imperative public necessity that the
   1-21  constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended,
   1-23  and that this Act take effect and be in force from and after its
    2-1  passage, and it is so enacted.
