Section 140.004, Local Government code, is 1-24 amended by adding Subsections (f), (g), (h), and (i) to read as 1-25 follows: 1-26 (f) A budget required by Subsection (b) shall not increase 1-27 the expenditure of county funds from the prior fiscal year by more 1-28 than the percentage increase in the caseload of the adult probation 1-29 department during the most recent 12 month period as reported to 1-30 the Community Justice Assistance Division of the Texas Department 1-31 of Criminal Justice, without the approval of the commissioners 1-32 court. 1-33 (g) A budget required by Subsection (b) shall not increase 1-34 the expenditure of county funds from the prior fiscal year by more 1-35 than the percentage increase in the delinquent referrals to the 1-36 juvenile probation department during the most recent 12 month 1-37 period as reported to the Texas Juvenile Probation Commission, 1-38 without the approval of the commissioners court. 1-39 (h) A county may deny an increase in funds determined by 1-40 Subsection (f) if the county certifies to the district judge or 1-41 judges that it does not have adequate funds to meet the increase. 1-42 (i) If the commissioners court grants an increase above the 1-43 amount provided by Subsection (f) or Subsection (g), the tax rate 1-44 necessary to generate the increased expenditure above the amount 1-45 provided by Subsection (f) or Subsection (g) shall be excluded from 1-46 the calculation of the Rollback Rate under Section 26.04 of the Tax 1-47 Code. 1-48 A BILL TO BE ENTITLED 1-49 AN ACT 1-50 relating to commissioners court approval of certain budgets. 1-51 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-52 SECTION 1. Section 140.004, Local Government Code, is 1-53 amended by adding Subsection (f) to read as follows: 1-54 (f) The budget required by Subsection (b) shall not increase 1-55 the expenditure of county funds unless the increase is approved by 1-56 the commissioners court. 1-57 SECTION 2. This Act takes effect September 1, 1993. 1-58 SECTION 3.
