                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to late voting because of death in immediate family.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Chapter 103 and Section 103.001(a), Election
    1-5  Code, is amended to read as follows:
    1-6        CHAPTER 103.  LATE VOTING BECAUSE OF DEATH IN ((IMMEDIATE))
    1-7  FAMILY.
    1-8        Sec. 103.001.  Eligibility.  (a)  A qualified voter is
    1-9  eligible to vote a late ballot as provided by this chapter if:
   1-10              (1)  the voter will be absent from the county of
   1-11  residence on election day due to the death of a spouse, parent,
   1-12  child, or grandparent <(because of the death of a person related to
   1-13  the voter within the first degree by consanguinity or affinity, as
   1-14  determined under Article 5996h, Revised Statutes)>; and
   1-15              (2)  the death occurs on or after the day before the
   1-16  last day of the period for early voting by personal appearance.
   1-17        SECTION 2.  This Act takes effect September 1, 1993.
   1-18        SECTION 3.  The importance of this legislation and the
   1-19  crowded condition of the calendars in both houses create an
   1-20  emergency and an imperative public necessity that the
   1-21  constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended.
