                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to credit in the Employees Retirement System of Texas for
    1-3  certain service performed for a county child welfare board.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter F, Chapter 813, Government Code, is
    1-6  amended by adding Section 813.510 to read as follows:
    1-7        Sec. 813.510.  CREDIT FOR COUNTY CHILD WELFARE BOARD SERVICE.
    1-8  (a)  An eligible member may, before September 1, 1994, claim
    1-9  service credit not otherwise creditable in the retirement system
   1-10  for service performed before September 1, 1980, for a county child
   1-11  welfare board.
   1-12        (b)  A member eligible to claim credit under this section is
   1-13  one who:
   1-14              (1)  was a contributing member on August 31, 1993,
   1-15  having performed at least 24 months of continuous state service as
   1-16  of that date; and
   1-17              (2)  was subject during the period of welfare board
   1-18  service to personnel rules of, and direct supervision by, the Texas
   1-19  Department of Human Services or its predecessor.
   1-20        (c)  A member may claim credit under this section by
   1-21  depositing with the retirement system in a lump sum:
   1-22              (1)  a contribution based on the member's monthly
   1-23  salary during the period of service for a county child welfare
    2-1  board and computed for the number of months for which credit is
    2-2  sought at the rate currently required of employee members of the
    2-3  system for new service;
    2-4              (2)  interest computed on the basis of the state fiscal
    2-5  year at an annual rate of 10 percent from the date the service was
    2-6  performed to the date of deposit; and
    2-7              (3)  any membership fees required of members of the
    2-8  system during the period beginning on the date the service began
    2-9  and ending on the date of deposit.
   2-10        (d)  The retirement system shall deposit the salary
   2-11  contribution in the member's individual account in the employees
   2-12  saving account, interest in the state accumulation account, and
   2-13  membership fees in the expense account.
   2-14        (e)  The retirement system shall determine the amount to be
   2-15  deposited in each case and may not grant service credit under this
   2-16  section until the required amount has been paid in full.
   2-17        (f)  Service credit may not be established under this section
   2-18  if the service is currently credited in another public retirement
   2-19  system.
   2-20        (g)  This section expires October 1, 1994.
   2-21        SECTION 2.  This Act takes effect September 1, 1993.
   2-22        SECTION 3.  The importance of this legislation and the
   2-23  crowded condition of the calendars in both houses create an
   2-24  emergency and an imperative public necessity that the
   2-25  constitutional rule requiring bills to be read on three several
    3-1  days in each house be suspended, and this rule is hereby suspended.
