                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the duty of County Clerk as recorder.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 11.004(a)(1), Property Code, is amended
    1-5  to read as follows:
    1-6        (a)  A county clerk shall:
    1-7              (1)  correctly record, as required by law, within a
    1-8  reasonable time after delivery, any instrument authorized or
    1-9  required to be recorded in that clerk's office that is proved,
   1-10  acknowledged, or sworn to according to law which has incorporated
   1-11  as part of the first page of the instrument the recorder's index
   1-12  information;
   1-13              (2)  give a receipt as required by law, for an
   1-14  instrument delivered for recording;
   1-15              (3)  record instruments relating to the same property
   1-16  in the order the instruments are filed; and
   1-17              (4)  provide and keep in the clerk's office the indexes
   1-18  required by law.
   1-19        SECTION 2.  This Act takes effect September 1, 1993.
   1-20        SECTION 3.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended.
