                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the right of the Texas Workers' Compensation Insurance
    1-3  Facility to sue in its own name.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 2.05, Article 5.76-2, Insurance Code, is
    1-6  amended by adding Subsection (m) to read as follows:
    1-7        (m)  In addition to all other rights of the facility under
    1-8  this Article, the Facility has all the legal rights of a private
    1-9  person in this state and the power to sue in its own name, and no
   1-10  procedure established in this Article is a prerequisite to the
   1-11  Facility's exercising the power to sue.
   1-12        SECTION 2.  This Act takes effect September 1, 1993.
   1-13        SECTION 3.  The importance of this legislation and the
   1-14  crowded condition of the calendars in both houses create an
   1-15  emergency and an imperative public necessity that the
   1-16  constitutional rule requiring bills to be read on three several
   1-17  days in each house be suspended, and this rule is hereby suspended.
