                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the authority of the Texas Workers' Compensation
    1-3  Insurance Facility to establish a multi-tiered premium system.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 4.05, Article 5.76-2, Insurance Code, is
    1-6  amended by adding Subsection (i) to read as follows:
    1-7        (i)  Notwithstanding any other provision of this article, the
    1-8  facility may, upon approval from the board, establish a
    1-9  multi-tiered premium system.  The premium system may:
   1-10              (1)  provide for higher premium payments by insureds
   1-11  who present higher than normal risks within a class;
   1-12              (2)  include a rating plan for individually rating a
   1-13  risk; and
   1-14              (3)  require a risk to meet other conditions considered
   1-15  necessary to protect the facility's interest.
   1-16        SECTION 2.  This Act takes effect September 1, 1993.
   1-17        SECTION 3.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended.
