1-1 AN ACT
1-2 relating to the Ector County Hospital District.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 5.15, Chapter 550, Acts of the 71st
1-5 Legislature, Regular Session, 1989, is amended to read as follows:
1-6 Sec. 5.15. AUTHORITY TO SUE AND BE SUED; VENUE. (a) The
1-7 board may sue and be sued on behalf of the district.
1-8 (b) An action against the board, the district, or the
1-9 district's hospital system shall be brought in Ector County.
1-10 SECTION 2. Section 7.04(b), Chapter 550, Acts of the 71st
1-11 Legislature, Regular Session, 1989, is amended to read as follows:
1-12 (b) The bonds must be payable from and secured by a pledge
1-13 of all or part of the revenues received by the district, other than
1-14 ad valorem taxes <derived from the operation of the district's
1-15 hospital system>. The bonds may be additionally secured by a
1-16 mortgage or deed of trust lien on all or part of district property.
1-17 SECTION 3. This Act does not affect the validity of the
1-18 assumption or issuance of bonds or other obligations assumed or
1-19 issued before the effective date of this Act.
1-20 SECTION 4. The importance of this legislation and the
1-21 crowded condition of the calendars in both houses create an
1-22 emergency and an imperative public necessity that the
1-23 constitutional rule requiring bills to be read on three several
2-1 days in each house be suspended, and this rule is hereby suspended,
2-2 and that this Act take effect and be in force from and after its
2-3 passage, and it is so enacted.
