A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to authorizing the Travis County Water Control and
1-3 Improvement District No. 17 to exclude certain territory.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. DEFINITIONS. In this Act:
1-6 (1) "District" means the Travis County Water Control
1-7 and Improvement District No. 17.
1-8 (2) "Board" means the board of directors of the
1-9 district.
1-10 SECTION 2. EXCLUSION OF TERRITORY. The board by order may
1-11 exclude from the district the following described area:
1-12 BEGINNING at the most northerly Northwest corner of Apache Shores
1-13 First Installment, a subdivision found of record in Book 43, Page
1-14 29, of the Plat Records of said County;
1-15 THENCE S3008'W, 1069.44 feet along the western boundary of said
1-16 subdivision to an ell corner thereof;
1-17 THENCE N5705'W, 667.46 feet along the southerly North boundary of
1-18 said subdivision to an ell corner thereof;
1-19 THENCE S3008'W, passing the Southwest corner of said subdivision
1-20 and the Northwest corner of Apache Shores Section Three, Amended
1-21 found of record in Book 50, Page 81 of said Plat Records at 534.38
1-22 feet and also passing the Southwest corner of said Section Three,
1-23 Amended and the Northwest corner of Apache Shores Section Five
1-24 found of record in Book 55, Page 41 of said Plat Records at 3629.19
2-1 feet and continue a total distance of 4673.11 feet to an angle
2-2 point in the West boundary line of said Section Five;
2-3 THENCE southerly along said West boundary line the following three
2-4 (3) courses:
2-5 1) S3010'W, 1204.08 feet to an angle point;
2-6 2) S3009'W, 791.12 feet to an angle point;
2-7 3) S3008'W, 336.40 feet to the Southwest corner of said Section
2-8 Five:
2-9 THENCE easterly along the South boundary line of said Section Five
2-10 the following four (4) courses:
2-11 1) S6007'E, 111.15 feet to an angle point;
2-12 2) S6139'E, 192.31 feet to an angle point;
2-13 3) S6109'E, 451.14 feet to an angle point;
2-14 4) S6012'E, 156.30 feet to the point of intersection of said
2-15 South line and the eastern boundary line of the aforesaid District
2-16 No. 17 for the Southeast corner hereof;
2-17 THENCE across the aforesaid sections of Apache Shores along the
2-18 eastern boundary line of District No. 17, N3008'E, 8024.26 feet to
2-19 the point of intersection of said eastern boundary line and the
2-20 North line of Apache Shores First Installment for the Northeast
2-21 corner hereof;
2-22 THENCE N5952'W, 243.09 feet along said North line to the POINT OF
2-23 BEGINNING of this described tract containing 151.67 acres of land.
2-24 SECTION 3. NOTICE TO TEXAS NATURAL RESOURCE CONSERVATION
2-25 COMMISSION. The board shall provide to the executive director of
2-26 the Texas Natural Resource Conservation Commission a detailed
2-27 description of the land excluded under this Act not later than 30
3-1 days after the effective date of the order excluding the land.
3-2 SECTION 4. Debt Service. The exclusion of territory under
3-3 this Act does not affect, diminish, or impair the rights of the
3-4 holders of any outstanding and unpaid bonds, warrants, or other
3-5 obligations of the district or the obligation of the board annually
3-6 to adjust the district's tax rate to provide sufficient tax
3-7 revenues for debt service.
3-8 SECTION 5. Apportionment of District Indebtedness. (a) The
3-9 board by order may release the excluded properties and improvements
3-10 from the obligation to pay the pro rata share of the district's
3-11 indebtedness.
3-12 (b) The district may resume taxation of the excluded
3-13 properties and improvements for the excluded area's pro rata share
3-14 of the district's remaining indebtedness for the bond series 1959,
3-15 1980, and 1986.
3-16 SECTION 6. TRANSITION PROVISION. The reference in Section 3
3-17 of this Act to the Texas Natural Resource Conservation Commission
3-18 means the Texas Water Commission until the name of the Texas Water
3-19 Commission is changed to the Texas Natural Resource Conservation
3-20 Commission as provided by Section 1.085, Chapter 3, Acts of the
3-21 72nd Legislature, 1st Called Session, 1991.
3-22 SECTION 7. EMERGENCY. The importance of this legislation
3-23 and the crowded condition of the calendars in both houses create an
3-24 emergency and an imperative public necessity that the
3-25 constitutional rule requiring bills to be read on three several
3-26 days in each house be suspended, and this rule is hereby suspended,
3-27 and that this Act take effect and be in force from and after its
4-1 passage, and it is so enacted.
