   1-19                         A BILL TO BE ENTITLED
   1-20                                AN ACT
   1-21  relating to authorizing the Travis County Water Control and
   1-22  Improvement District No. 17 to exclude certain territory.
   1-23        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-24        SECTION 1.  DEFINITIONS.  In this Act:
   1-25              (1)  "District" means the Travis County Water Control
   1-26  and Improvement District No. 17.
   1-27              (2)  "Board" means the board of directors of the
   1-28  district.
   1-29        SECTION 2.  EXCLUSION OF TERRITORY.  The board by order may
   1-30  exclude from the district the following described area:
   1-31  BEGINNING at the most northerly Northwest corner of Apache Shores
   1-32  First Installment, a subdivision found of record in Book 43, Page
   1-33  29, of the Plat Records of said County;
   1-34  THENCE S3008'W, 1069.44 feet along the western boundary of said
   1-35  subdivision to an ell corner thereof;
   1-36  THENCE N5705'W, 667.46 feet along the southerly North boundary of
   1-37  said subdivision to an ell corner thereof;
   1-38  THENCE S3008'W, passing the Southwest corner of said subdivision
   1-39  and the Northwest corner of Apache Shores Section Three, Amended
   1-40  found of record in Book 50, Page 81 of said Plat Records at 534.38
   1-41  feet and also passing the Southwest corner of said Section Three,
   1-42  Amended and the Northwest corner of Apache Shores Section Five
   1-43  found of record in Book 55, Page 41 of said Plat Records at 3629.19
   1-44  feet and continue a total distance of 4673.11 feet to an angle
   1-45  point in the West boundary line of said Section Five;
   1-46  THENCE southerly along said West boundary line the following three
   1-47  (3) courses:
   1-48  1)  S3010'W, 1204.08 feet to an angle point;
   1-49  2)  S3009'W, 791.12 feet to an angle point;
   1-50  3)  S3008'W, 336.40 feet to the Southwest corner of said Section
   1-51  Five:
   1-52  THENCE easterly along the South boundary line of said Section Five
   1-53  the following four (4) courses:
   1-54  1)  S6007'E, 111.15 feet to an angle point;
   1-55  2)  S6139'E, 192.31 feet to an angle point;
   1-56  3)  S6109'E, 451.14 feet to an angle point;
   1-57  4)  S6012'E, 156.30 feet to the point of intersection of said
   1-58  South line and the eastern boundary line of the aforesaid District
   1-59  No. 17 for the Southeast corner hereof;
   1-60  THENCE across the aforesaid sections of Apache Shores along the
   1-61  eastern boundary line of District No. 17, N3008'E, 8024.26 feet to
   1-62  the point of intersection of said eastern boundary line and the
   1-63  North line of Apache Shores First Installment for the Northeast
   1-64  corner hereof;
   1-65  THENCE N5952'W, 243.09 feet along said North line to the POINT OF
   1-66  BEGINNING of this described tract containing 151.67 acres of land.
   1-67        SECTION 3.  NOTICE TO TEXAS NATURAL RESOURCE CONSERVATION
   1-68  COMMISSION.  The board shall provide to the executive director of
    2-1  the Texas Natural Resource Conservation Commission a detailed
    2-2  description of the land excluded under this Act not later than 30
    2-3  days after the effective date of the order excluding the land.
    2-4        SECTION 4.  Debt Service.  The exclusion of territory under
    2-5  this Act does not affect, diminish, or impair the rights of the
    2-6  holders of any outstanding and unpaid bonds, warrants, or other
    2-7  obligations of the district or the obligation of the board annually
    2-8  to adjust the district's tax rate to provide sufficient tax
    2-9  revenues for debt service.
   2-10        SECTION 5.  Apportionment of District Indebtedness.  (a)  The
   2-11  board by order may release the excluded properties and improvements
   2-12  from the obligation to pay the pro rata share of the district's
   2-13  indebtedness.
   2-14        (b)  The district may resume taxation of the excluded
   2-15  properties and improvements for the excluded area's pro rata share
   2-16  of the district's remaining indebtedness for the bond series 1959,
   2-17  1980, and 1986.
   2-18        SECTION 6.  TRANSITION PROVISION.  The reference in Section 3
   2-19  of this Act to the Texas Natural Resource Conservation Commission
   2-20  means the Texas Water Commission until the name of the Texas Water
   2-21  Commission is changed to the Texas Natural Resource Conservation
   2-22  Commission as provided by Section 1.085, Chapter 3, Acts of the
   2-23  72nd Legislature, 1st Called Session, 1991.
   2-24        SECTION 7.  EMERGENCY.  The importance of this legislation
   2-25  and the crowded condition of the calendars in both houses create an
   2-26  emergency and an imperative public necessity that the
   2-27  constitutional rule requiring bills to be read on three several
   2-28  days in each house be suspended, and this rule is hereby suspended,
   2-29  and that this Act take effect and be in force from and after its
   2-30  passage, and it is so enacted.
