A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the juvenile board of Castro, Hale, and Swisher
1-3 counties.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Sections 152.0411(a), (c), (d), (g), and (h),
1-6 Human Resources Code, are amended to read as follows:
1-7 (a) The juvenile board of Castro<, Hale,> and Swisher
1-8 counties is composed of the county judges, the district judges in
1-9 Castro<, Hale,> and Swisher counties, and the judge of any
1-10 statutory court designated as a juvenile court in the counties.
1-11 (c) The commissioners courts of the counties shall pay the
1-12 members of the juvenile board an annual salary set by the
1-13 commissioners court at not less than $1,200, payable in equal
1-14 monthly installments from the general fund of the counties. The
1-15 counties shall apportion and pay the salary according to the method
1-16 determined by the counties <ratio used to pay the expenses of the
1-17 64th and 242nd judicial districts>.
1-18 (d) The counties shall apportion and pay the juvenile board
1-19 costs, other than the judge's salaries, according to the method
1-20 determined by the counties <ratio used to pay the expenses of the
1-21 64th and 242nd judicial districts, unless the counties agree to use
1-22 a different method of allocating costs>.
1-23 (g) The juvenile board shall appoint an advisory council
1-24 composed of five citizens from different parts of Castro<, Hale,>
2-1 and Swisher counties.
2-2 (h) Sections 152.0004 and 152.0005(b) do not apply to the
2-3 juvenile board in Castro<, Hale,> and Swisher counties.
2-4 SECTION 2. Section 152.1011, Human Resources Code, is
2-5 amended to read as follows:
2-6 Sec. 152.1011. Hale County. (a) The juvenile board of
2-7 <Castro,> Hale County<, and Swisher counties> is composed of the
2-8 county judge <judges>, the district judges in <Castro,> Hale
2-9 County<, and Swisher counties>, and the judge of any statutory
2-10 court designated as a juvenile court in the county <counties>.
2-11 (b) The juvenile board shall elect one of its members as
2-12 chairman.
2-13 (c) The commissioners court shall pay the members of the
2-14 juvenile board an annual salary set by the commissioners court at
2-15 not less than $1,200, payable in equal monthly installments from
2-16 the general fund of the county.
2-17 (d) The commissioners court shall pay the salaries and
2-18 expenses of juvenile probation personnel and other expenses the
2-19 chairman certifies as essential to provide services to children
2-20 from the general funds or any other available funds of the county.
2-21 (e) A member of the juvenile board is not liable in civil
2-22 damages or for criminal prosecution for an action taken by the
2-23 juvenile board.
2-24 (f) The juvenile board shall appoint an advisory council
2-25 composed of five citizens from different parts of Hale County.
2-26 (g) Sections 152.0004 and 152.0005(b) do not apply to the
2-27 juvenile board in Hale County <Section 152.0411 applies to the
3-1 juvenile board of Castro, Hale, and Swisher counties>.
3-2 SECTION 3. Section 152.2251, Human Resources Code, is
3-3 amended to read as follows:
3-4 Sec. 152.2251. Swisher County. (a) The juvenile board of
3-5 Castro<, Hale,> and Swisher counties is composed of the county
3-6 judges, the district judges in Castro<, Hale,> and Swisher
3-7 counties, and the judge of any statutory court designated as a
3-8 juvenile court in the counties.
3-9 (b) Section 152.0411 applies to the juvenile board of
3-10 Castro<, Hale,> and Swisher counties.
3-11 SECTION 4. On October 1, 1993, or an earlier date provided
3-12 by agreement, Castro, Hale, and Swisher counties shall implement
3-13 the changes made by this Act to Sections 152.0411, 152.1011, and
3-14 152.2251, Human Resources Code.
3-15 SECTION 5. The importance of this legislation and the
3-16 crowded condition of the calendars in both houses create an
3-17 emergency and an imperative public necessity that the
3-18 constitutional rule requiring bills to be read on three several
3-19 days in each house be suspended, and this rule is hereby suspended,
3-20 and that this Act take effect and be in force from and after its
3-21 passage, and it is so enacted.
