1-20 A BILL TO BE ENTITLED
1-21 AN ACT
1-22 relating to the juvenile board of Castro, Hale, and Swisher
1-23 counties.
1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-25 SECTION 1. Sections 152.0411(a), (c), (d), (g), and (h),
1-26 Human Resources Code, are amended to read as follows:
1-27 (a) The juvenile board of Castro<, Hale,> and Swisher
1-28 counties is composed of the county judges, the district judges in
1-29 Castro<, Hale,> and Swisher counties, and the judge of any
1-30 statutory court designated as a juvenile court in the counties.
1-31 (c) The commissioners courts of the counties shall pay the
1-32 members of the juvenile board an annual salary set by the
1-33 commissioners court at not less than $1,200, payable in equal
1-34 monthly installments from the general fund of the counties. The
1-35 counties shall apportion and pay the salary according to the method
1-36 determined by the counties <ratio used to pay the expenses of the
1-37 64th and 242nd judicial districts>.
1-38 (d) The counties shall apportion and pay the juvenile board
1-39 costs, other than the judge's salaries, according to the method
1-40 determined by the counties <ratio used to pay the expenses of the
1-41 64th and 242nd judicial districts, unless the counties agree to use
1-42 a different method of allocating costs>.
1-43 (g) The juvenile board shall appoint an advisory council
1-44 composed of five citizens from different parts of Castro<, Hale,>
1-45 and Swisher counties.
1-46 (h) Sections 152.0004 and 152.0005(b) do not apply to the
1-47 juvenile board in Castro<, Hale,> and Swisher counties.
1-48 SECTION 2. Section 152.1011, Human Resources Code, is
1-49 amended to read as follows:
1-50 Sec. 152.1011. Hale County. (a) The juvenile board of
1-51 <Castro,> Hale County<, and Swisher counties> is composed of the
1-52 county judge <judges>, the district judges in <Castro,> Hale
1-53 County<, and Swisher counties>, and the judge of any statutory
1-54 court designated as a juvenile court in the county <counties>.
1-55 (b) The juvenile board shall elect one of its members as
1-56 chairman.
1-57 (c) The commissioners court shall pay the members of the
1-58 juvenile board an annual salary set by the commissioners court at
1-59 not less than $1,200, payable in equal monthly installments from
1-60 the general fund of the county.
1-61 (d) The commissioners court shall pay the salaries and
1-62 expenses of juvenile probation personnel and other expenses the
1-63 chairman certifies as essential to provide services to children
1-64 from the general funds or any other available funds of the county.
1-65 (e) A member of the juvenile board is not liable in civil
1-66 damages or for criminal prosecution for an action taken by the
1-67 juvenile board.
1-68 (f) The juvenile board shall appoint an advisory council
2-1 composed of five citizens from different parts of Hale County.
2-2 (g) Sections 152.0004 and 152.0005(b) do not apply to the
2-3 juvenile board in Hale County <Section 152.0411 applies to the
2-4 juvenile board of Castro, Hale, and Swisher counties>.
2-5 SECTION 3. Section 152.2251, Human Resources Code, is
2-6 amended to read as follows:
2-7 Sec. 152.2251. Swisher County. (a) The juvenile board of
2-8 Castro<, Hale,> and Swisher counties is composed of the county
2-9 judges, the district judges in Castro<, Hale,> and Swisher
2-10 counties, and the judge of any statutory court designated as a
2-11 juvenile court in the counties.
2-12 (b) Section 152.0411 applies to the juvenile board of
2-13 Castro<, Hale,> and Swisher counties.
2-14 SECTION 4. On October 1, 1993, or an earlier date provided
2-15 by agreement, Castro, Hale, and Swisher counties shall implement
2-16 the changes made by this Act to Sections 152.0411, 152.1011, and
2-17 152.2251, Human Resources Code.
2-18 SECTION 5. The importance of this legislation and the
2-19 crowded condition of the calendars in both houses create an
2-20 emergency and an imperative public necessity that the
2-21 constitutional rule requiring bills to be read on three several
2-22 days in each house be suspended, and this rule is hereby suspended,
2-23 and that this Act take effect and be in force from and after its
2-24 passage, and it is so enacted.
