1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to terms of office of members of the board of
1-22 commissioners of the Brazoria County Conservation and Reclamation
1-23 District Number Three.
1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-25 SECTION 1. Section 16, Chapter 307, Acts of the 61st
1-26 Legislature, Regular Session, 1969 (Article 8280-476, Vernon's
1-27 Texas Civil Statutes), is amended to read as follows:
1-28 Sec. 16. The <present> commissioners of the <drainage>
1-29 district <who shall become members of the board of commissioners of
1-30 the district on the effective date of this Act, or their
1-31 successors, shall hold office until January 1, 1971. Their
1-32 successors shall be elected at the next general election on the
1-33 first Tuesday after the first Monday in November, 1970, when there
1-34 shall be an election within the district for the election of the
1-35 successors of the members of the first board of commissioners.
1-36 Commissioners> shall <thereafter> be elected <every two years> at
1-37 the general election for county and state officers held on the
1-38 first Tuesday after the first Monday in November in even-numbered
1-39 years, and shall serve staggered four-year <two-year> terms with
1-40 the terms of two commissioners and one commissioner, alternately,
1-41 commencing on January 1 of the year following each <such> general
1-42 election.
1-43 SECTION 2. (a) The commissioners of the Brazoria County
1-44 Conservation and Reclamation District Number Three who are
1-45 presently serving as commissioners of the district shall hold
1-46 office until January 1, 1995.
1-47 (b) Notwithstanding Section 16, Chapter 307, Acts of the
1-48 61st Legislature, Regular Session, 1969 (Article 8280-476, Vernon's
1-49 Texas Civil Statutes), as amended by this Act, at the general
1-50 election held November 8, 1994, commissioners shall be elected to
1-51 hold place number one and place number three for four-year terms
1-52 and a commissioner shall be elected to hold place number two for a
1-53 two-year term. On expiration of the initial term, the term of the
1-54 commissioner elected to hold place number two is four years.
1-55 SECTION 3. The importance of this legislation and the
1-56 crowded condition of the calendars in both houses create an
1-57 emergency and an imperative public necessity that the
1-58 constitutional rule requiring bills to be read on three several
1-59 days in each house be suspended, and this rule is hereby suspended,
1-60 and that this Act take effect and be in force from and after its
1-61 passage, and it is so enacted.
