No. 2870 73R9106 JJT-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to conflicts of interest of certain persons in certain 1-3 contracts of certain fresh water supply districts. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 53.123, Water Code, is amended by adding 1-6 Subsection (c) to read as follows: 1-7 (c) For a district that contains less than 2,200 acres 1-8 within its boundaries, is located in a county that is adjacent to 1-9 the Gulf of Mexico, and was created before 1956, a person may not 1-10 be held to have violated Subsection (a) of this section unless the 1-11 person's direct or indirect interest in the district's contract 1-12 violates Section 171.003, Local Government Code. A contract of a 1-13 district described by this section that is made in accordance with 1-14 Chapter 171, Local Government Code, is valid and enforceable 1-15 notwithstanding Subsection (a) of this section. 1-16 SECTION 2. The importance of this legislation and the 1-17 crowded condition of the calendars in both houses create an 1-18 emergency and an imperative public necessity that the 1-19 constitutional rule requiring bills to be read on three several 1-20 days in each house be suspended, and this rule is hereby suspended, 1-21 and that this Act take effect and be in force from and after its 1-22 passage, and it is so enacted.
