   1-19                         A BILL TO BE ENTITLED
   1-20                                AN ACT
   1-21  relating to conflicts of interest of certain persons in certain
   1-22  contracts of certain fresh water supply districts.
   1-23        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-24        SECTION 1.  Section 53.123, Water Code, is amended by adding
   1-25  Subsection (c) to read as follows:
   1-26        (c)  For a district that contains less than 2,200 acres
   1-27  within its boundaries, is located in a county that is adjacent to
   1-28  the Gulf of Mexico, and was created before 1956, a person may not
   1-29  be held to have violated Subsection (a) of this section unless the
   1-30  person's direct or indirect interest in the district's contract
   1-31  violates Section 171.003, Local Government Code.  A contract of a
   1-32  district described by this section that is made in accordance with
   1-33  Chapter 171, Local Government Code, is valid and enforceable
   1-34  notwithstanding Subsection (a) of this section.
   1-35        SECTION 2.  The importance of this legislation and the
   1-36  crowded condition of the calendars in both houses create an
   1-37  emergency and an imperative public necessity that the
   1-38  constitutional rule requiring bills to be read on three several
   1-39  days in each house be suspended, and this rule is hereby suspended,
   1-40  and that this Act take effect and be in force from and after its
   1-41  passage, and it is so enacted.
