    1-6  Gallardo, Gerald Huerta, Jacob Hernandez, Raul Jimenez, Douglas

   1-11  Tijerina, Victor Tellez, Oscar Uribe, Melquiades Velasques, and
   1-12  Alberto Zambrano allege that:
   1-13              (1)  they were employed by the State of Texas and were
   1-14  members of the Texas Army National Guard or the Texas Air National
   1-15  Guard;
   1-16              (2)  they were victims of statewide systemic racial or
   1-17  age discrimination of which the defendants had knowledge and which
   1-18  the defendants perpetuated or condoned;
   1-19              (3)  as a result of the discrimination, they were
   1-20  wrongfully terminated from their positions and were denied equal
   1-21  opportunities in promotion;
   1-22              (4)  they suffered other injuries and denial of rights
   1-23  as a result of the discrimination;
   1-24              (5)  they represent a class of persons with similar
    2-1  claims and the suit that they seek to bring may be certified as a
    2-2  class action under the Texas Rules of Civil Procedure; and
    2-3              (6)  they and the unnamed members of the class are
    2-4  entitled to actual damages in excess of $100,000,000; now,
    2-5  therefore, be it
    2-6        RESOLVED by the Legislature of the State of Texas, That the
    2-7  persons named above and the unnamed members of the class, if
    2-8  certified, are granted permission to sue the State of Texas and
    2-9  Governor Ann W. Richards, former Governor William P.  Clements,
   2-10  former Governor Mark White, former Governor Dolph Briscoe, Adjutant
   2-11  General Sam Turk, former Adjutant General William Wilson, former
   2-12  Adjutant General James Dennis, former Adjutant General Willie
   2-13  Scott, and former Adjutant General Thomas Bishop subject to Chapter
   2-14  107, Civil Practice and Remedies Code; and, be it further
   2-15        RESOLVED, That Governor Ann W. Richards, former Governor
   2-16  William P.  Clements, former Governor Mark White, former Governor
   2-17  Dolph Briscoe, Adjutant General Sam Turk, former Adjutant General
   2-18  William Wilson, former Adjutant General James Dennis, former
   2-19  Adjutant General Willie Scott, and former Adjutant General Thomas
   2-20  Bishop be served process as provided by Section 107.002(a)(3),
   2-21  Civil Practice and Remedies Code.
