                                 CONCURRENT RESOLUTION
    1-1        WHEREAS, The United States District Court for the Western
    1-2  District of Texas and the United States Court of Appeals for the
    1-3  5th Circuit, in the case of LULAC, Council No. 4434, vs. Clements,
    1-4  have held that the state's current method of electing district
    1-5  court judges, as applied in several counties, violates Section 2 of
    1-6  the federal Voting Rights Act; and
    1-7        WHEREAS, The policy of the State of Texas expressed in its
    1-8  constitution and laws is that election of district court judges be
    1-9  by partisan, popular election; and
   1-10        WHEREAS, It is necessary that the policies of the state be
   1-11  consistent with requirements of federal law, and it also is
   1-12  desirable that the legislature express its preference for
   1-13  resolution of the pending litigation; now, therefore, be it
   1-14        RESOLVED, That the 73rd Legislature of the State of Texas
   1-15  hereby declare its finding that its preference as expressed herein
   1-16  is consistent with all provisions of the Texas Constitution; and,
   1-17  be it further
   1-18        RESOLVED, That, in those counties affected by the LULAC
   1-19  litigation, for district court elections in 1994 and thereafter,
   1-20  judges be elected from places composed of state representative
   1-21  districts, commissioners court precincts, or justice precincts as
   1-22  assigned by the legislature; and, be it further
   1-23        RESOLVED, That Subchapter A, Chapter 24, Government Code, be
   1-24  amended by adding Section 24.0015 to read as follows:
    2-1        Sec. 24.0015.  RESIDENCY REQUIREMENT OF JUDGES.  A district
    2-2  judge elected by place from an area that is less than the entire
    2-3  judicial district may, but need not, be a resident of the area from
    2-4  which elected.; and, be it further
    2-5        RESOLVED, That, effective January 1, 1995, Subchapter C,
    2-6  Chapter 24, Government Code, be amended by adding Sections
    2-7  24.523-24.530 to read as follows:
    2-8        Sec. 24.523.  378TH JUDICIAL DISTRICT (HARRIS COUNTY).  (a)
    2-9  The 378th Judicial District is composed of Harris County.
   2-10        (b)  The district has 35 judges who are elected from state
   2-11  representative districts as provided by Subsection (c).  For
   2-12  purposes of this section, a state representative district is
   2-13  composed of the area in the district on January 1, 1993.
   2-14        (c)  One judge shall be elected for each of the following
   2-15  places:
   2-16              (1)  places 1 and 26 shall be elected by voters
   2-17  residing in state representative district 126;
   2-18              (2)  places 2 and 27 shall be elected by voters
   2-19  residing in state representative district 127;
   2-20              (3)  places 3 and 28 shall be elected by voters
   2-21  residing in state representative district 128;
   2-22              (4)  places 4  and 29 shall be elected by voters
   2-23  residing in state representative district 129;
   2-24              (5)  places 5 and 30 shall be elected by voters
   2-25  residing in state representative district 130;
   2-26              (6)  places 6 and 31 shall be elected by voters

   4-12        Sec. 24.524.  379TH JUDICIAL DISTRICT (DALLAS COUNTY).  (a)
   4-13  The 379th Judicial District is composed of Dallas County.
   4-14        (b)  The district has 30 judges who are elected from state
   4-15  representative districts as provided by Subsection (c).  For
   4-16  purposes of this section, a state representative district is
   4-17  composed of the area in the district on January 1, 1993.
   4-18        (c)  One judge shall be elected for each of the following
   4-19  places:
   4-20              (1)  places 1 and 17 shall be elected by voters
   4-21  residing in state representative district 99;
   4-22              (2)  places 2  and 18 shall be elected by voters
   4-23  residing in state representative district 100;
   4-24              (3)  places 3 and 19 shall be elected by voters
   4-25  residing in state representative district 101;
   4-26              (4)  places 4 and 20 shall be elected by voters
   4-27  residing in state representative district 102;
    5-1              (5)  places 5 and 21 shall be elected by voters
    5-2  residing in state representative district 103;
    5-3              (6)  places 6 and 22 shall be elected by voters
    5-4  residing in state representative district 104;
    5-5              (7)  places 7 and 23 shall be elected by voters
    5-6  residing in state representative district 105;

   5-25        Sec. 24.525.  380TH JUDICIAL DISTRICT (TARRANT COUNTY).  (a)
   5-26  The 380th Judicial District is composed of Tarrant County.
   5-27        (b)  The district has 14 judges who are elected from state
    6-1  representative districts as provided by Subsection (c).  For
    6-2  purposes of this section, a state representative district is
    6-3  composed of the area in the district on January 1, 1993.
    6-4        (c)  One judge shall be elected for each of the following
    6-5  places:
    6-6              (1)  places 1 and 11 shall be elected by voters
    6-7  residing in state representative district 89;
    6-8              (2)  places 2 and 12 shall be elected by voters
    6-9  residing in state representative district 90;
   6-10              (3)  places 3 and 13 shall be elected by voters
   6-11  residing in state representative district 91;
   6-12              (4)  places 4 and 14 shall be elected by voters
   6-13  residing in state representative district 92;
   6-14              (5)  place 5 shall be elected by voters residing in
   6-15  state representative district 93;
   6-16              (6)  place 6 shall be elected by voters residing in
   6-17  state representative district 94;
   6-18              (7)  place 7 shall be elected by voters residing in
   6-19  state representative district 95;
   6-20              (8)  place 8 shall be elected by voters residing in

   6-22              (9)  place 9 shall be elected by voters residing in

   6-26        Sec. 24.526.  381ST JUDICIAL DISTRICT (BEXAR COUNTY).  (a)
   6-27  The 381st Judicial District is composed of Bexar County.
    7-1        (b)  The district has 13 judges who are elected from state
    7-2  representative districts as provided by Subsection (c).  For
    7-3  purposes of this section, a state representative district is
    7-4  composed of the area in the district on January 1, 1993.
    7-5        (c)  One judge shall be elected for each of the following
    7-6  places:
    7-7              (1)  places 1 and 12 shall be elected by voters
    7-8  residing in state representative district 115;
    7-9              (2)  places 2 and 13 shall be elected by voters
   7-10  residing in state representative district 116;
   7-11              (3)  place 3 shall be elected by voters residing in
   7-12  state representative district 117;
   7-13              (4)  place 4 shall be elected by voters residing in
   7-14  state representative district 118;
   7-15              (5)  place 5 shall be elected by voters residing in
   7-16  state representative district 119;
   7-17              (6)  place 6 shall be elected by voters residing in
   7-18  state representative district 120;
   7-19              (7)  place 7 shall be elected by voters residing in

    8-2        Sec. 24.527.  382ND JUDICIAL DISTRICT (JEFFERSON COUNTY).
    8-3  (a)  The 382nd Judicial District is composed of Jefferson County.
    8-4        (b)  The district has six judges who are elected from state
    8-5  representative districts and parts of state representative
    8-6  districts as provided by Subsection (c).  For purposes of this
    8-7  section, a state representative district is composed of the area in
    8-8  the district on January 1, 1993.
    8-9        (c)  One judge shall be elected for each of the following
   8-10  places:
   8-11              (1)  places 1 and 3 shall be elected by voters residing
   8-12  in state representative district 22; and
   8-13              (2)  places 2, 4, 5, and 6 shall be elected by voters
   8-14  residing in state representative district 21 and the voters
   8-15  residing in that part of state representative district 19 in
   8-16  Jefferson County.
   8-17        Sec. 24.528.  383RD JUDICIAL DISTRICT (LUBBOCK COUNTY).  (a)
   8-18  The 383rd Judicial District is composed of Lubbock County.
   8-19        (b)  The district has three judges who are elected from
   8-20  commissioners court precincts as provided by Subsection (c).  For
   8-21  purposes of this section, a commissioners court precinct is
   8-22  composed of the area in the precinct on January 1, 1993.
   8-23        (c)  One judge shall be elected for each of the following
   8-24  places:
   8-25              (1)  place 1 shall be elected by voters residing in
   8-26  Commissioners Court Precinct No. 1 of Lubbock County;
   8-27              (2)  place 2 shall be elected by voters residing in
    9-1  Commissioners Court Precinct No. 2 of Lubbock County; and
    9-2              (3)  place 3 shall be elected by voters residing in
    9-3  Commissioners Court Precinct No. 3 of Lubbock County.
    9-4        Sec. 24.529.  384TH JUDICIAL DISTRICT (ECTOR COUNTY).  (a)
    9-5  The 384th Judicial District is composed of Ector County.
    9-6        (b)  The district has two judges who are elected from
    9-7  commissioners court precincts as provided by Subsection (c).  For
    9-8  purposes of this section, a commissioners court precinct is
    9-9  composed of the area in the precinct on January 1, 1993.
   9-10        (c)  One judge shall be elected for each of the following
   9-11  places:
   9-12              (1)  place 1 shall be elected by voters residing in
   9-13  Commissioners Court Precinct No. 1 of Ector County; and
   9-14              (2)  place 2 shall be elected by voters residing in
   9-15  Commissioners Court Precinct No. 2 of Ector County.
   9-16        Sec. 24.530.  385TH JUDICIAL DISTRICT (MIDLAND COUNTY).  (a)
   9-17  The 385th Judicial District is composed of Midland County.
   9-18        (b)  The district has two judges who are elected from
   9-19  commissioners court precincts as provided by Subsection (c).  For
   9-20  purposes of this section, a commissioners court precinct is
   9-21  composed of the area in the precinct on January 1, 1993.
   9-22        (c)  One judge shall be elected for each of the following
   9-23  places:
   9-24              (1)  place 1 shall be elected by voters residing in
   9-25  Commissioners Court Precinct No. 3 of Midland County; and
   9-26              (2)  place 2 shall be elected by voters residing in
   9-27  Commissioners Court Precincts Nos. 1, 2, and 4 of Midland County.;
   10-1  and, be it further
   10-2        RESOLVED, That, effective January 1, 1997, Sections 24.523(b)
   10-3  and (c), Government Code, as proposed herein, be amended to read as
   10-4  follows:
   10-5        (b)  The district has 59 <35> judges who are elected from
   10-6  state representative districts as provided by Subsection (c).  For
   10-7  purposes of this section, a state representative district is
   10-8  composed of the area in the district on January 1, 1993.
   10-9        (c)  One judge shall be elected for each of the following
  10-10  places:

   15-6        (c)  One judge shall be elected for each of the following
   15-7  places:
   15-8              (1)  places 1 and 12 shall be elected by voters
   15-9  residing in state representative district 115;

   16-8  state representative districts and parts of state representative
   16-9  districts as provided by Subsection (c).  For purposes of this
  16-10  section, a state representative district is composed of the area in
  16-11  the district on January 1, 1993.
  16-12        (c)  One judge shall be elected for each of the following
  16-13  places:
  16-14              (1)  places 1, <and> 3, and 7 shall be elected by
  16-15  voters residing in state representative district 22; and
  16-16              (2)  places 2, 4, 5, <and> 6, and 8 shall be elected by
  16-17  voters residing in state representative district 21 and the voters
  16-18  residing in that part of state representative district 19 in
  16-19  Jefferson County.; and, be it further
  16-20        RESOLVED, That, effective January 1, 1997, Sections 24.528(b)
  16-21  and (c), Government Code, as proposed herein, be amended to read as
  16-22  follows:
  16-23        (b)  The district has six <three> judges who are elected from
  16-24  commissioners court precincts as provided by Subsection (c).  For
  16-25  purposes of this section, a commissioners court precinct is
  16-26  composed of the area in the precinct on January 1, 1993.
  16-27        (c)  One judge shall be elected for each of the following
   17-1  places:
   17-2              (1)  place 1 shall be elected by voters residing in
   17-3  Commissioners Court Precinct No. 1 of Lubbock County;
   17-4              (2)  places <place> 2 and 4 shall be elected by voters
   17-5  residing in Commissioners Court Precinct No. 2 of Lubbock County;

  17-17  commissioners court precincts as provided by Subsection (c).  For
  17-18  purposes of this section, a commissioners court precinct is
  17-19  composed of the area in the precinct on January 1, 1993.
  17-20        (c)  One judge shall be elected for each of the following
  17-21  places:
  17-22              (1)  place 1 shall be elected by voters residing in
  17-23  Commissioners Court Precinct No. 1 of Ector County; <and>
  17-24              (2)  place 2 shall be elected by voters residing in

   18-4        RESOLVED, That, effective January 1, 1997, Sections 24.530(b)
   18-5  and (c), Government Code, as proposed herein, be amended to read as
   18-6  follows:
   18-7        (b)  The district has three <two> judges who are elected from
   18-8  commissioners court precincts as provided by Subsection (c).  For
   18-9  purposes of this section, a commissioners court precinct is
  18-10  composed of the area in the precinct on January 1, 1993.
  18-11        (c)  One judge shall be elected for each of the following
  18-12  places:
  18-13              (1)  place 1 shall be elected by voters residing in
  18-14  Commissioners Court Precinct No. 3 of Midland County; and
  18-15              (2)  places <place> 2 and 3 shall be elected by voters
  18-16  residing in Commissioners Court Precincts Nos. 1, 2, and 4 of
  18-17  Midland County.; and, be it further
  18-18        RESOLVED, That, (a)  effective January 1, 1995, the following
  18-19  sections of the Government Code be repealed:

  19-14        RESOLVED, That, (a)  effective January 1, 1997, the following
  19-15  sections of the Government Code be repealed:

   20-3        (b)  a judicial district created by a section of the
   20-4  Government Code that is repealed pursuant to Section (a) of this

   20-6        RESOLVED, That, (a)  the judicial offices created pursuant to
   20-7  the fourth resolving clause herein exist for purposes of the
   20-8  primary and general elections for state and county officers in
   20-9  1994;
  20-10        (b)  the judicial offices created pursuant to resolving
  20-11  clauses five through twelve herein exist for purposes of the
  20-12  primary and general elections for state and county officers in
  20-13  1996.
