                                  R E S O L U T I O N
    1-1        BE IT RESOLVED by the House of Representatives of the State
    1-2  of Texas, That Rule 13, Section 9(a), Rules of the House of
    1-3  Representatives, 73rd Legislature, is suspended, as provided by
    1-4  House Rule 13, Section 9(f), to the extent described in this
    1-5  resolution, to enable the conference committee appointed to adjust
    1-6  the differences between the house and senate versions of H.B. 1185,
    1-7  relating to purchasing by local governments, to successfully
    1-8  conclude the committee's deliberations by authorizing the conferees
    1-9  to consider and take action on the following specific matter:
   1-10        House Rule 13, Section 9(a)(1), is suspended to permit the
   1-11  Committee to insert a new SECTION 17 to read as follows:
   1-12        SECTION 17.  TEX. REV. CIV. STAT. ANN., art. 3271a, Section
   1-13  19(a) is amended to read as follows:
   1-14        (a)  It is unlawful for this State or for any of its
   1-15  political subdivisions, including any county, city, or town, to
   1-16  engage in the construction of any public work involving
   1-17  professional engineering, where public health, public welfare or
   1-18  public safety is involved, unless the engineering plans and
   1-19  specifications and estimates have been prepared by, and the
   1-20  engineering construction is to be executed under the direct
   1-21  supervision of a registered professional engineer.  However,
   1-22  nothing in this Act shall be held to apply to any public work
   1-23  involving structural, electrical, or mechanical engineering wherein
    2-1  the contemplated expenditure for the completed project does not
    2-2  exceed Eight Thousand ($8,000.00) Dollars.  Nothing in this Act
    2-3  shall be held to apply to other public work wherein the
    2-4  contemplated expenditure for the completed project does not exceed
    2-5  Twenty Thousand ($20,000.00) Dollars.
    2-6        This action is necessary to clarify that a city need not
    2-7  engage the services of a registered professional engineer for a
    2-8  project that costs less than $20,000 and does not involve
    2-9  structural, mechanical, or electrical engineering.
