R E S O L U T I O N
1-1 BE IT RESOLVED by the House of Representatives of the State
1-2 of Texas, That Rule 13, Section 9(a), Rules of the House of
1-3 Representatives, 73rd Legislature, is suspended, as provided by
1-4 House Rule 13, Section 9(f), to the extent described in this
1-5 resolution, to enable the conference committee appointed to adjust
1-6 the differences between the House and Senate versions of S.B. No.
1-7 947, relating to continuing legal education, technical assistance,
1-8 and other support programs for prosecuting attorneys and their
1-9 personnel, for criminal defense attorneys who regularly represent
1-10 indigent defendants, and for justices of the peace and their court
1-11 personnel, to successfully conclude the committee's deliberations,
1-12 by authorizing the conferees to consider and take action on the
1-13 following specific matters:
1-14 (1) House Rule 13, Section 9(a)(1), is suspended to permit
1-15 the committee to amend the SECTION of the House third reading
1-16 amendment to the bill adding Section 56.006, Government Code, to
1-17 read as follows:
1-18 "SECTION _____. Chapter 56, Government Code, is amended by
1-19 adding Section 56.007 to read as follows:
1-20 "Sec. 56.007. ADMINISTRATIVE EXPENSES. An entity receiving
1-21 a grant of funds from the court of criminal appeals under this
1-22 chapter for continuing legal education, technical assistance, and
1-23 other support programs may not use grant funds to pay any costs of
2-1 the entity not related to approved grant activities."
2-2 This action is necessary to make a technical correction to
2-3 and clarify the legislative intent of House 3rd Reading Amendment
2-4 No. 1.
2-5 (2) House Rule 13, Section 9(a)(3), is suspended to permit
2-6 the committee to add the following appropriately numbered SECTION
2-7 to the bill to read as follows:
2-8 "SECTION _____.
2-9 "1. All funds appropriated to the Supreme Court of Texas in
2-10 Senate Bill 5, Acts of the Seventy-third Legislature, Regular
2-11 Session, in line item 2., Judicial and Court Personnel Training,
2-12 and on page IV-17 in rider provision 5., Appropriation, Judicial
2-13 Education, are hereby transferred to the Court of Criminal Appeals
2-14 for the same period and for the same purposes as indicated in that
2-15 Act.
2-16 "2. All rider provisions in Article IV, Senate Bill 5,
2-17 Seventy-third Legislature, Regular Session, limiting, controlling,
2-18 or otherwise affecting the appropriations transferred pursuant to
2-19 subsection 1 of this section shall continue to apply to said
2-20 appropriations and a reference therein to the Supreme Court of
2-21 Texas shall be deemed a reference to the Court of Criminal Appeals.
2-22 "3. Section 5., Contingency Appropriation, Judicial Education, at
2-23 page IV-28 in the Special Provisions - Judiciary of Senate Bill 5,
2-24 Acts of the Seventy-third Legislature, Regular Session, shall have
2-25 no effect."

3-2 transfer certain appropriations, which provision was intended to be
3-3 added as a rider to the General Appropriations Act.
