H.R. No. 850
                                  R E S O L U T I O N
    1-1        BE IT RESOLVED by the House of Representatives of the State
    1-2  of Texas, That Rule 13, Section 9(a), Rules of the House of
    1-3  Representatives, 73rd Legislature, is suspended, as provided by
    1-4  House Rule 13, Section 9(f), to the extent described in this
    1-5  resolution, to enable the conference committee appointed to adjust
    1-6  the differences between the house and senate versions of S.B.
    1-7  No. 1051, relating to the reduction of solid waste by creating
    1-8  markets for recycled materials, otherwise promoting recycling, and
    1-9  the use of recycled materials and by municipal solid waste
   1-10  management, to successfully conclude the committee's deliberations,
   1-11  by authorizing the conferees to consider and take action on the
   1-12  following specific matter:
   1-13        (1)  House Rule 13, Section 9(a)(1), is suspended to permit
   1-14  the committee to insert a new Section 3, Section 361.472(a), to
   1-15  read as follows:
   1-16  (a)  A wholesale or retail tire dealer who sells or offers to sell
   1-17  new tires not for resale shall collect at the time and place of
   1-18  sale a waste tire recycling fee <of $2> for each new <automobile,
   1-19  van, bus, truck, trailer, semitrailer, truck tractor and
   1-20  semitrailer combination, or recreational vehicle> tire sold as
   1-21  follows:
   1-22              (1)  $2 for each tire that has a rim diameter <equal to
   1-23  or greater than> 12 inches but less than 17.5 <26> inches; and
    2-1              (2)  $3.50 for each tire that has a rim diameter of
    2-2  17.5 inches but less than 25 inches; and
    2-3              (3)  $2 for a motorcycle tire, regardless of the rim
    2-4  diameter.
    2-5        This action is necessary to compensate for the disparity
    2-6  between the weight of a truck tire in comparison to an automobile
    2-7  tire and the cost to the state for processing these tires.
