                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to Laredo State University.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Subsections (a) and (b), Section 87.501,
    1-4  Education Code, are amended to read as follows:
    1-5        (a)  Texas A&M International <Laredo State> University is a
    1-6  coeducational upper-level educational institution located in the
    1-7  city of Laredo.  The upper-level institution is a component
    1-8  institution of The Texas A&M University System and is under the
    1-9  management and control of the board of regents of The Texas A&M
   1-10  University System.
   1-11        (b)  The board has the same powers and duties concerning
   1-12  Texas A&M International <Laredo State> University as are conferred
   1-13  on it by statute concerning Texas A&M University.
   1-14        SECTION 2.  Effective September 1, 1995, Subsections (a) and
   1-15  (c), Section 87.501, Education Code, are amended to read as
   1-16  follows:
   1-17        (a)  Texas A&M International <Laredo State> University is a
   1-18  coeducational <upper-level> educational institution located in the
   1-19  city of Laredo.  The <upper-level> institution is a component
   1-20  institution of The Texas A&M University System and is under the
   1-21  management and control of the board of regents of The Texas A&M
   1-22  University System.
   1-23        (c)  The <upper-level> institution may teach undergraduate or
   1-24  graduate <only junior, senior, and master's> level courses.
    2-1        SECTION 3.  Subsections (d) and (e), Section 87.502,
    2-2  Education Code, are amended to read as follows:
    2-3        (d)  The board shall adopt other rules for the operation,
    2-4  control, and management of Texas A&M International <Laredo State>
    2-5  University as may be necessary for the institution to be a
    2-6  first-class upper-level institution of higher education.
    2-7        (e)  The board may make joint faculty appointments in Texas
    2-8  A&M International <Laredo State> University and in other
    2-9  institutions under its governance.  The salary of a person who
   2-10  receives a joint appointment shall be apportioned to the appointing
   2-11  institution on the basis of services rendered.
   2-12        SECTION 4.  Effective September 1, 1995, Subsections (a),
   2-13  (b), and (d), Section 87.502, Education Code, are amended to read
   2-14  as follows:
   2-15        (a)  The board, with the approval of the Texas Higher
   2-16  Education Coordinating Board, may prescribe courses leading to
   2-17  customary degrees as are offered at leading American educational
   2-18  institutions and may award those degrees.
   2-19        (b)  The degrees offered by the <upper-level> institution may
   2-20  include <only> baccalaureate, <and> master's, and doctoral degrees
   2-21  and their equivalents.
   2-22        (d)  The board shall adopt other rules for the operation,
   2-23  control, and management of Texas A&M International <Laredo State>
   2-24  University as may be necessary for the institution to be a
   2-25  first-class <upper-level> institution of higher education.
   2-26        SECTION 5.  Section 87.502, Education Code, is amended by
   2-27  adding Subsection (f) to read as follows:
    3-1        (f)  The board, with the approval of the Texas Higher
    3-2  Education Coordinating Board, may contract with the governing board
    3-3  of another general academic teaching institution, as defined by
    3-4  Section 61.003 of this code, or with the governing board of a
    3-5  college or university in Mexico, to offer joint degree programs.
    3-6        SECTION 6.  Section 87.503, Education Code, is amended to
    3-7  read as follows:
    3-8        Sec. 87.503.  GRADUATE SCHOOL OF INTERNATIONAL TRADE.
    3-9  Subject to the approval of the governing board of Texas A&M
   3-10  International <Laredo State> University and the Texas Higher
   3-11  Education Coordinating Board, a graduate school of international
   3-12  trade at Texas A&M International <Laredo State> University shall be
   3-13  established.
   3-14        SECTION 7.  Subsection (a), Section 87.504, Education Code,
   3-15  is amended to read as follows:
   3-16        (a)  The board shall establish a center for border economic
   3-17  and enterprise development at Texas A&M International <Laredo
   3-18  State> University.
   3-19        SECTION 8.  Effective September 1, 1995, Subchapter C,
   3-20  Chapter 61, Education Code, is amended by adding Section 61.0592 to
   3-21  read as follows:
   3-22        Sec. 61.0592.  UPPER-LEVEL TRANSITION FUNDING FOR TEXAS A&M
   3-23  INTERNATIONAL UNIVERSITY.  (a)  Notwithstanding Section 61.059 of
   3-24  this code, a formula adopted by the board under that section that
   3-25  provides a differential rate for each semester credit hour between
   3-26  four-year general academic teaching institutions and upper-level
   3-27  institutions shall be modified and applied as provided by this
    4-1  section to Texas A&M International University.
    4-2        (b)  In addition to other funding that Texas A&M
    4-3  International University is entitled to receive, the university is
    4-4  entitled to receive additional funds in accordance with this
    4-5  section.
    4-6        (c)  The formula for four-year general academic teaching
    4-7  institutions shall be applied to all lower-division semester credit
    4-8  hours.
    4-9        (d)  For the first two state fiscal years that begin after
   4-10  Texas A&M International University first admits lower-division
   4-11  students or offers lower-division courses, the formula for
   4-12  upper-level general academic teaching institutions shall be applied
   4-13  to upper-division semester credit hours at the university.
   4-14        (e)  Beginning with the third state fiscal year that begins
   4-15  after Texas A&M International University first admits
   4-16  lower-division students or offers lower-division courses, the
   4-17  formula for four-year general academic teaching institutions shall
   4-18  be applied to upper-division semester credit hours at the
   4-19  university, except that the board shall modify the formula to
   4-20  provide the university additional funding equal to a percent of the
   4-21  difference between the amount derived from the application of the
   4-22  four-year formula to the university's upper-division semester
   4-23  credit hours and the amount derived from the application of the
   4-24  upper-level formula to those semester credit hours.  The percent to
   4-25  be applied to that difference is 87.5 percent for the first fiscal
   4-26  year to which this subsection applies and is reduced by 12.5
   4-27  percentage points for each subsequent fiscal year.
    5-1        SECTION 9.  The heading to Subchapter F, Chapter 87,
    5-2  Education Code, is amended to read as follows:
    5-3   SUBCHAPTER F.  TEXAS A&M INTERNATIONAL <LAREDO STATE> UNIVERSITY
    5-4        SECTION 10.  Section 55.1712, Education Code, is amended to
    5-5  read as follows:
    5-6        Sec. 55.1712.  TEXAS A&M INTERNATIONAL <LAREDO STATE>
    5-7  UNIVERSITY.  (a)  The board of regents of The Texas A&M University
    5-8  System may acquire, purchase, construct, improve, enlarge, and
    5-9  equip property, buildings, structures, facilities, roads, and
   5-10  related infrastructure for Texas A&M International <Laredo State>
   5-11  University.
   5-12        (b)  The board may finance those items listed under
   5-13  Subsection (a) of this section through the issuance of bonds under
   5-14  this subchapter and in accordance with its existing system-wide
   5-15  revenue financing program.  The board may pledge irrevocably to the
   5-16  payment of those bonds all or any part of the aggregate amount of
   5-17  student tuition charges required or authorized by law to be imposed
   5-18  on students enrolled at Texas A&M International <Laredo State>
   5-19  University.  The amount of a pledge made under this subsection may
   5-20  not be reduced or abrogated while the bonds for which the pledge is
   5-21  made, or bonds issued to refund those bonds, are outstanding.
   5-22        (c)  Bonds issued under this section may not be issued in an
   5-23  aggregate principal amount exceeding $30 million.
   5-24        SECTION 11.  Section 61.055, Education Code, is amended to
   5-25  read as follows:
   5-26        Sec. 61.055.  Initiation of New Departments, Schools, and
   5-27  Programs.  Except as otherwise provided by law, a <No> new
    6-1  department, school, or degree or certificate program approved by
    6-2  the board or its predecessor, the Texas Commission on Higher
    6-3  Education, may not be initiated by any institution of higher
    6-4  education until the board has made a written finding that the
    6-5  department, school, or degree or certificate program is adequately
    6-6  financed by legislative appropriation, by funds allocated by the
    6-7  board, or by funds from other sources.
    6-8        SECTION 12.  Subsection (a), Section 62.021, Education Code,
    6-9  is amended to read as follows:
   6-10        (a)  Each fiscal year, an eligible institution is entitled to
   6-11  receive an amount allocated in accordance with this section from
   6-12  funds appropriated by Article VII, Section 17(a), of the
   6-13  Constitution of Texas.  The comptroller of public accounts shall
   6-14  distribute funds allocated under this subsection only on
   6-15  presentation of a claim and issuance of a warrant in accordance
   6-16  with Section 403.071, Government Code.  The comptroller may not
   6-17  issue a warrant from any funds allocated under this subsection
   6-18  before the delivery of goods or services described in Section 17,
   6-19  Article VII, Texas Constitution, except for the payment of
   6-20  principal or interest on bonds or notes.  The allocation of funds
   6-21  under this subsection is made in accordance with an equitable
   6-22  formula consisting of the following elements:  space deficit,
   6-23  facilities condition, institutional complexity, separate allocation
   6-24  for medical units, and additional allocation for compliance with
   6-25  the Texas Desegregation Plan.  The amounts allocated by such
   6-26  formula are as follows:

   8-19        (e)  The center established under this section shall

   8-21  International <Laredo State> University, The University of
   8-22  Texas--Pan American <University>, and other institutions of higher
   8-23  education.
   8-24        SECTION 14.  Subsection (e), Section 77.36, Education Code,
   8-25  is amended to read as follows:
   8-26        (e)  The center established under this section shall
   8-27  cooperate fully with similar programs operated by The University of
    9-1  Texas at El Paso, Texas A&M International <Laredo State>
    9-2  University, and other institutions of higher education.
    9-3        SECTION 15.  Subsection (b), Section 481.060, Government
    9-4  Code, is amended to read as follows:
    9-5        (b)  The electronic data base advisory committee is composed
    9-6  of:
    9-7              (1)  a representative from the center for border
    9-8  economic and enterprise development at The University of Texas at
    9-9  El Paso, appointed by the president of the university;
   9-10              (2)  a representative from the University of North
   9-11  Texas Institute for Regional Industrialization and Manufacturing
   9-12  Technology, appointed by the president of the university;
   9-13              (3)  a representative from the Bureau of Business
   9-14  Research at The University of Texas at Austin, appointed by the
   9-15  president of the university;
   9-16              (4)  a representative from the Texas Agriculture Market

   10-8        SECTION 16.  Paragraph (A), Subdivision (5), Section 2,
   10-9  Chapter 421, Acts of the 63rd Legislature, Regular Session, 1973
  10-10  (Article 6252-9b, Vernon's Texas Civil Statutes), is amended to
  10-11  read as follows:
  10-12                    (A)  "Appointed officer of a major state agency"
  10-13  means any of the following:

   15-9        SECTION 17.  (a)  The name of Laredo State University is
  15-10  changed to Texas A&M International University.
  15-11        (b)  A reference in law to Laredo State University means
  15-12  Texas A&M International University.
  15-13        (c)  An appropriation for the use and benefit of Laredo State
  15-14  University is available for the use and benefit of Texas A&M
  15-15  International University.
  15-16        (d)  Before using new stationery or other supplies printed
  15-17  with the university's name as changed by this Act, the university
  15-18  shall use all stationery and other supplies that are printed with
  15-19  the university's former name and that are in its possession on the
  15-20  effective date of this Act.
  15-21        SECTION 18.  Except as otherwise provided by this Act, this
  15-22  Act takes effect September 1, 1993.
  15-23        SECTION 19.  The importance of this legislation and the
  15-24  crowded condition of the calendars in both houses create an
  15-25  emergency and an imperative public necessity that the
  15-26  constitutional rule requiring bills to be read on three several
  15-27  days in each house be suspended, and this rule is hereby suspended,
   16-1  and that this Act take effect and be in force according to its
   16-2  terms, and it is so enacted.
