   1-19                         A BILL TO BE ENTITLED
   1-20                                AN ACT
   1-21  relating to performance bonds required of county contractors.
   1-22        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-23        SECTION 1.  Subsection (b), Section 262.032, Local Government
   1-24  Code, is amended to read as follows:
   1-25        (b)  Within 30 <10> days after the date of the signing of a
   1-26  contract or issuance of a purchase order following the acceptance
   1-27  of a bid or proposal and prior to commencement of the actual work,
   1-28  the bidder or proposal offeror shall furnish a performance bond to
   1-29  the county, if required  by the county, for the full amount of the
   1-30  contract if that contract exceeds $50,000.
   1-31        SECTION 2.  The importance of this legislation and the
   1-32  crowded condition of the calendars in both houses create an
   1-33  emergency and an imperative public necessity that the
   1-34  constitutional rule requiring bills to be read on three several
   1-35  days in each house be suspended, and this rule is hereby suspended.
