AN ACT
1-1 relating to tuition paid by certain nonresident students enrolled
1-2 in a public technical institute.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Subsection (a), Section 54.060, Education Code,
1-5 is amended to read as follows:
1-6 (a) The nonresident tuition fee prescribed in this chapter
1-7 does not apply to a nonresident student who is a resident of
1-8 Arkansas, Louisiana, New Mexico, or Oklahoma <a state situated
1-9 adjacent to Texas> and who registers in any Texas public junior
1-10 college or public technical institute, as defined by Section 61.003
1-11 of this code, that is situated in a county immediately adjacent to
1-12 the state in which the nonresident student resides. The
1-13 nonresident tuition fee prescribed in this chapter does not apply
1-14 to a nonresident student who is a resident of New Mexico or
1-15 Oklahoma and who registers in a public technical institute that is
1-16 situated in a county that is within 100 miles of the state in which
1-17 the nonresident student resides and who is admitted for the purpose
1-18 of utilizing available instructional facilities. The nonresident
1-19 junior college or public technical institute student described in
1-20 this section shall pay an amount equivalent to the amount charged a
1-21 Texas student registered at a similar school in the state in which
1-22 the nonresident student resides. The nonresident student described
1-23 in this section shall pay equivalent fees and charges to those
1-24 charged Texas students registered at a similar institution in the
2-1 state in which the nonresident student resides, when such student
2-2 registers at a Texas public senior upper level (those institutions
2-3 offering only junior, senior, and graduate level programs)
2-4 institution of higher education located within the Texas public
2-5 junior college district or within the county in which the public
2-6 technical institute is located or adjacent to such county and from
2-7 which the nonresident student has graduated or completed 45
2-8 semester credit hours.
2-9 SECTION 2. Section 54.060, Education Code, is amended by
2-10 adding Subsection (e) to read as follows:
2-11 (e) The payment of resident tuition at a public technical
2-12 institute as authorized by Subsection (a) of this section does not
2-13 affect the constitutionally dedicated funding to which institutions
2-14 of higher education are entitled under Article VII, Section 17, of
2-15 the Texas Constitution.
2-16 SECTION 3. Subsection (a), Section 54.060, Education Code,
2-17 as amended by this Act, applies only to tuition for the fall
2-18 semester in 1993 and thereafter.
2-19 SECTION 4. The importance of this legislation and the
2-20 crowded condition of the calendars in both houses create an
2-21 emergency and an imperative public necessity that the
2-22 constitutional rule requiring bills to be read on three several
2-23 days in each house be suspended, and this rule is hereby suspended,
2-24 and that this Act take effect and be in force from and after its
2-25 passage, and it is so enacted.
