   1-20 AN ACT
1-21 relating to tuition paid by certain nonresident students enrolled
1-22 in a public technical institute.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-24 SECTION 1. Subsection (a), Section 54.060, Education Code,
1-25 is amended to read as follows:
1-26 (a) The nonresident tuition fee prescribed in this chapter
1-27 does not apply to a nonresident student who is a resident of a
1-28 state situated adjacent to Texas and who registers in any Texas
1-29 public junior college or public technical institute, as defined by
1-30 Section 61.003 of this code, that is situated in a county
1-31 immediately adjacent to the state in which the nonresident student
1-32 resides. The nonresident junior college or public technical
1-33 institute student described in this section shall pay an amount
1-34 equivalent to the amount charged a Texas student registered at a
1-35 similar school in the state in which the nonresident student
1-36 resides. The nonresident student described in this section shall
1-37 pay equivalent fees and charges to those charged Texas students
1-38 registered at a similar institution in the state in which the
1-39 nonresident student resides, when such student registers at a Texas
1-40 public senior upper level (those institutions offering only junior,
1-41 senior, and graduate level programs) institution of higher
1-42 education located within the Texas public junior college district
1-43 or within the county in which the public technical institute is
1-44 located and from which the nonresident student has graduated or
1-45 completed 45 semester credit hours.
   1-46 SECTION 2. Subsection (a), Section 54.060, Education Code,
1-47 as amended by this Act, applies only to tuition for the fall
1-48 semester in 1993 and thereafter.
1-49 SECTION 3. The importance of this legislation and the
1-50 crowded condition of the calendars in both houses create an
1-51 emergency and an imperative public necessity that the
1-52 constitutional rule requiring bills to be read on three several
1-53 days in each house be suspended, and this rule is hereby suspended,
1-54 and that this Act take effect and be in force from and after its
1-55 passage, and it is so enacted.
