                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the elements of the offense of driving while
    1-3  intoxicated.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Article 6701l-1(a)(2), Revised Statutes, is
    1-6  amended to read as follows:
    1-7              (2)  "Intoxicated" means:
    1-8                    (A)  not having the normal use of mental or
    1-9  physical faculties by reason of the introduction of alcohol, a
   1-10  controlled substance, a drug, a substance or its vapors that
   1-11  contain a volatile chemical, an abusable glue, or an aerosol paint,
   1-12  or a combination of two or more of those substances into the body;
   1-13  or
   1-14                    (B)  having an alcohol concentration of 0.10 or
   1-15  more.
   1-16        SECTION 2.  Article 6701l-1(a), Revised Statutes, is amended
   1-17  by adding Subdivisions (8), (9), and (10) to read as follows:
   1-18              (8)  "Abusable glue" has the meaning assigned by
   1-19  Section 485.001, Health and Safety Code.
   1-20              (9)  "Aerosol paint" has the meaning assigned by
   1-21  Section 485.001, Health and Safety Code.
   1-22              (10)  "Volatile chemical" is a chemical or isomer
   1-23  listed in Section 484.002, Health and Safety Code.
   1-24        SECTION 3.  This Act takes effect September 1, 1993.
    2-1        SECTION 4.  The importance of this legislation and the
    2-2  crowded condition of the calendars in both houses create an
    2-3  emergency   and   an   imperative   public   necessity   that   the
    2-4  constitutional rule requiring bills to be read on three several
    2-5  days in each house be suspended, and this rule is hereby suspended.
