   1-21                         A BILL TO BE ENTITLED
   1-22                                AN ACT
   1-23  relating to the elements of the offense of driving while
   1-24  intoxicated.
   1-25        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-26        SECTION 1.  Subdivision (2), Subsection (a), Article 6701l-1,
   1-27  Revised Statutes, is amended to read as follows:
   1-28              (2)  "Intoxicated" means:
   1-29                    (A)  not having the normal use of mental or
   1-30  physical faculties by reason of the introduction of alcohol, a
   1-31  controlled substance, a drug, a substance or its vapors that
   1-32  contain a volatile chemical, an abusable glue, or an aerosol paint,
   1-33  or a combination of two or more of those substances into the body;
   1-34  or
   1-35                    (B)  having an alcohol concentration of 0.10 or
   1-36  more.
   1-37        SECTION 2.  Subsection (a), Article 6701l-1, Revised
   1-38  Statutes, is amended by adding Subdivisions (8), (9), and (10) to
   1-39  read as follows:
   1-40              (8)  "Abusable glue" has the meaning assigned by
   1-41  Section 485.001, Health and Safety Code.
   1-42              (9)  "Aerosol paint" has the meaning assigned by
   1-43  Section 485.001, Health and Safety Code.
   1-44              (10)  "Volatile chemical" is a chemical or isomer
   1-45  listed in Section 484.002, Health and Safety Code.
   1-46        SECTION 3.  This Act takes effect September 1, 1993.
   1-47        SECTION 4.  The importance of this legislation and the
   1-48  crowded condition of the calendars in both houses create an
   1-49  emergency   and   an   imperative   public   necessity   that   the
   1-50  constitutional rule requiring bills to be read on three several
   1-51  days in each house be suspended, and this rule is hereby suspended.
