No. 135 A BILL TO BE ENTITLED AN ACT 1-1 relating to commissions for honorably retired inspectors and 1-2 representatives of the Texas Alcoholic Beverage Commission. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subchapter A, Chapter 5, Alcoholic Beverage Code, 1-5 is amended by adding Section 5.142 to read as follows: 1-6 Sec. 5.142. SPECIAL INSPECTORS OR REPRESENTATIVES. (a) The 1-7 commission or administrator may appoint as a special inspector or 1-8 representative an honorably retired commissioned inspector or 1-9 representative. 1-10 (b) A special inspector or representative is subject to the 1-11 orders of the commission and is subject to the orders of the 1-12 governor for special duty to the same extent as other law 1-13 enforcement officers. 1-14 (c) Before issuance of a commission to a special inspector 1-15 or representative, the person shall enter into a good and 1-16 sufficient bond executed by a surety company authorized to do 1-17 business in the state in the amount of $2,500, approved by the 1-18 commission, and indemnifying all persons against damages resulting 1-19 from an unlawful act of the person as a special inspector or 1-20 representative. 1-21 (d) A special inspector or representative is not entitled to 1-22 compensation from the state for service as a special inspector or 1-23 representative. 1-24 (e) A special inspector or representative commission expires 2-1 January 1 of the first odd-numbered year after appointment. The 2-2 commission may revoke a special inspector or representative 2-3 commission at any time for cause. 2-4 SECTION 2. The importance of this legislation and the 2-5 crowded condition of the calendars in both houses create an 2-6 emergency and an imperative public necessity that the 2-7 constitutional rule requiring bills to be read on three several 2-8 days in each house be suspended, and this rule is hereby suspended, 2-9 and that this Act take effect and be in force from and after its 2-10 passage, and it is so enacted.
