                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the creation of the offense of unlawful transfer of a
    1-3  handgun by a firearms dealer.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Chapter 46, Penal Code, is amended by adding
    1-6  Section 46.071 to read as follows:
    1-7        Sec. 46.071.  UNLAWFUL TRANSFER OF HANDGUN BY FIREARMS
    1-8  DEALER.  (a)  A firearms dealer commits an offense if the firearms
    1-9  dealer knowingly sells, rents, or leases a handgun to a person
   1-10  unless the firearms dealer:
   1-11              (1)  obtains a signed and dated written agreement from
   1-12  the person to purchase, rent, or lease the handgun; and
   1-13              (2)  does not transfer the handgun to the person before
   1-14  the eighth day after the date the person signed the agreement.
   1-15        (b)  In this section, "firearms dealer" means a person
   1-16  licensed as a firearms dealer under 18 U.S.C. Sec. 921 et seq.
   1-17        (c)  An offense under this section is a Class A misdemeanor.
   1-18        SECTION 2.  This Act takes effect September 1, 1993.
   1-19        SECTION 3.  The importance of this legislation and the
   1-20  crowded condition of the calendars in both houses create an
   1-21  emergency   and   an   imperative   public   necessity   that   the
   1-22  constitutional rule requiring bills to be read on three several
   1-23  days in each house be suspended, and this rule is hereby suspended.
