No. 155 By: Turner 1-17 A BILL TO BE ENTITLED 1-18 AN ACT 1-19 relating to the creation of the Texas Commission on Children and 1-20 Youth. 1-21 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-22 SECTION 1. Subtitle B, Title 3, Human Resources Code, is 1-23 amended by adding Chapter 71 to read as follows: 1-24 CHAPTER 71. TEXAS COMMISSION ON CHILDREN AND YOUTH 1-25 Sec. 71.001. CREATION. The Texas Commission on Children and 1-26 Youth is created. 1-27 Sec. 71.002. COMPOSITION. (a) The commission is composed 1-28 of 18 members, six of whom are appointed by the governor, six of 1-29 whom are appointed by the lieutenant governor, and six of whom are 1-30 appointed by the speaker of the house of representatives. Not 1-31 fewer than three of the members appointed by the lieutenant 1-32 governor shall be members of the senate and not fewer than three of 1-33 the members appointed by the speaker of the house of 1-34 representatives shall be members of the house of representatives. 1-35 (b) In making appointments under this section, the governor 1-36 shall attempt to ensure participation on the commission by women 1-37 and minorities, including African-Americans, Hispanic-Americans, 1-38 Native Americans, and Asian-Americans. 1-39 (c) Each appointed member of the commission serves at the 1-40 pleasure of the official by whom the member is appointed. 1-41 (d) The governor shall designate one member to serve as 1-42 chairman and one member to serve as vice-chairman. 1-43 (e) The commission shall include as ex officio members the 1-44 executive director or commissioner of: 1-45 (1) the Central Education Agency; 1-46 (2) the Texas Youth Commission; 1-47 (3) the Texas Juvenile Probation Commission; 1-48 (4) the Department of Protective and Regulatory 1-49 Services; 1-50 (5) the Texas Department of Health; 1-51 (6) the Texas Department of Human Services; 1-52 (7) the Children's Trust Fund of Texas Council; 1-53 (8) the Health and Human Services Commission; 1-54 (9) the Texas Department of Criminal Justice; 1-55 (10) the Texas Department of Mental Health and Mental 1-56 Retardation; 1-57 (11) the Texas Agricultural Extension Service; and 1-58 (12) any other agency that the governor identifies as 1-59 an agency that serves children. 1-60 Sec. 71.003. POWERS AND DUTIES. (a) The commission shall 1-61 develop a comprehensive proposal to improve and coordinate public 1-62 programs for children and to achieve the goals listed in this 1-63 section for education, health care, juvenile justice, and family 1-64 services. 1-65 (b) In education, the commission's goals are to: 1-66 (1) reduce the rate of school dropouts; 1-67 (2) increase parental involvement and accountability; 1-68 (3) review disciplinary procedures; and 2-1 (4) ensure that all children are prepared to enter the 2-2 work force on graduation. 2-3 (c) In health care, the commission's goal is to increase 2-4 access for all children to basic health care, including preventive 2-5 care, prenatal care, immunization, and mental health services. The 2-6 commission shall not study, offer proposals, or otherwise pursue 2-7 the adoption of policies or strategies related to sex education or 2-8 dissemination of or instruction concerning contraceptives or 2-9 contraceptive methods. 2-10 (d) In juvenile justice, the commission's goals are to: 2-11 (1) improve services for predelinquent children and 2-12 children at risk of becoming delinquent or in need of supervision; 2-13 (2) provide effective supervision, treatment, and 2-14 aftercare services for children in the juvenile justice system; and 2-15 (3) establish a mechanism for cooperation among 2-16 agencies that deal with juvenile crime. 2-17 (e) In family services, the commission's goals are to: 2-18 (1) improve prevention, detection, and treatment of 2-19 the abuse or neglect of children; 2-20 (2) review the rules governing foster care for 2-21 children; and 2-22 (3) recommend ways to provide child care for all 2-23 children of working parents. 2-24 (f) The commission shall organize community-based 2-25 commissions throughout the state to promote cooperation among 2-26 government, voluntary organizations, and other private interests in 2-27 meeting the needs of children, encouraging the involvement of 2-28 parents and volunteers, and developing local solutions to the 2-29 problems of children. 2-30 (g) The commission may solicit and accept gifts, grants, and 2-31 donations for the purposes of this subchapter. 2-32 Sec. 71.004. REIMBURSEMENT. A member of the commission is 2-33 not entitled to compensation but is entitled to reimbursement for 2-34 actual and necessary expenses incurred in performing his or her 2-35 official duties. 2-36 Sec. 71.005. STAFF; CONTRACTS. (a) The commission may hire 2-37 staff as needed for research and other support services. 2-38 (b) The commission may contract with agencies of the state 2-39 or private contractors for research and other support services. 2-40 Sec. 71.006. SUBMISSION. The commission shall submit the 2-41 commission's proposal described by Section 71.003 to the governor, 2-42 the lieutenant governor, and the speaker of the house of 2-43 representatives not later than December 1, 1994. 2-44 Sec. 71.007. COMMISSION ABOLISHED; EXPIRATION OF CHAPTER. 2-45 (a) The commission is abolished on September 1, 1995. 2-46 (b) This chapter expires on September 1, 1995. 2-47 SECTION 2. The governor, lieutenant governor, and speaker of 2-48 the house of representatives shall make their appointments to the 2-49 Texas Commission on Children and Youth not later than the 31st day 2-50 after the effective date of this Act. 2-51 SECTION 3. The importance of this legislation and the 2-52 crowded condition of the calendars in both houses create an 2-53 emergency and an imperative public necessity that the 2-54 constitutional rule requiring bills to be read on three several 2-55 days in each house be suspended, and this rule is hereby suspended, 2-56 and that this Act take effect and be in force from and after its 2-57 passage, and it is so enacted. 2-58 * * * * * 2-59 Austin, 2-60 Texas 2-61 February 24, 2-62 1993 2-63 Hon.
